Ruthless Representatives, Unjust Executions (2/3): Tribunals and Arrests

In Part 1 of this series, I listed three memoirs that included details on Saint-Just condemning an artillery captain to death and described their inconsistencies. @josefavomjaaga has noted that the overall arc of the story is still true, which raises the question: did the captain actually get executed?

Dr. Lawrence Joseph Fischer, in his paper about Jourdan’s career in the Revolutionary army, says of this affair: "The evidence reveals that much of this was threat only; the artillery captain, for example, was never guillotined.” He adds in a footnote: "Such punishments were announced in each order of the day; no such execution, or even arrest, of any artillery captain was ever announced, either before or after Fleurus." (p. 214) If the artillery captain was executed, there would have to written evidence, because if there was one thing civilians were good at doing, it was paperwork!

Indeed, a look through official documents of the representatives, such as vol. 2 of the Œuvres completes of Saint-Just, turns up no news about the execution of an artillery captain. However, Saint-Just's Œuvres do contain correspondence and proclamations that Saint-Just made during his time as a representative in the Army of the Nord. The text shows that despite threatening executions around every corner, Saint-Just does not act on his word as much as expected.

First off, the decree for forming the extrajudicial military tribunals that Saint-Cyr condemned (cited by @josefavomjaaga in this post) indeed did exist. It was proclaimed on 4 May 1794, the second time Saint-Just and Le Bas went to the Nord. See pages 404, and 406-407, documents number 2. and 7., for more details.

7. The Representatives of the People to the Army of the Nord decree the following: Article 1. — The agents or partisans of the enemy who are found either in the Army of the Nord, or in the surroundings of this army, the prevaricating agents in all posts of the same army, will be shot in the presence of the army. Article 2. — The military tribunal sitting at Réunion-sur-Oise is raised to this effect by the special and revolutionary Commission and will not, for the cases mentioned above, be subject to any particular form of procedure. Article 3. — The tribunal will pronounce in the same manner in the fate of those imprisoned at Réunion-sur-Oise if they know agents or partisans of the enemy. To Réunion-sur-Oise, 15 floréal, year II of the Republic one and indivisible. LE BAS, SAINT-JUST. (pp. 406-407)

Two further decrees of 21 floréal/10 May adds the military tribunal are authorised to print their verdicts, and affirms that “until further notice the military tribunal of the army will make judgements without being bound by the formality of the jury.” (pp. 413-414) Saint-Just and Le Bas give their reasoning in the following document of 27 floréal/16 May:

Proclamation to the Army of the Nord Soldiers, We call you back to rigourous dicipline, which alone can make you conquer, and which spares our blood; abuses have crept in among you; we have resolved to repress them. Those who provoke the infantry to disband in front of the enemy cavalry, those who leave the line before combat, during the combat, or during the retreat, will be arrested on the hour and punished by death. All cantonments will carry out patrols; they will recognise errant soldiers and arrest them; if they flee, they [the patrols] will fire. Soldiers, we will do you justice; we will punish those who refused it to you; we will share your work; but whoever deviates from his duty will be struck with a prompt death. […] (pp. 414-415)

These proclamations are extreme in its character, but I don’t doubt that indiscipline was occurring in the army. On 25 priarial/13 June, the Representatives specify that anyone convicted of having commandering supplies, implying that such excesses occurred, would be brought to the tribunal and punished with death (p. 430). We can debate whether the representatives’ proclamations were the cause of more privations and desertions, but there was reason for the representatives to watch the armies on the north-eastern frontier so closely. Fischer, in his paper on Jourdan, assesses the army of the Nord pre-Jourdan:

[...] the generals of the 'Nord' worked amid the aftereffects of the Dumouriez conspiracy. The sudden treason of the most powerful general of the Republic had shaken the government greatly. To men such as Robespierre and St Just, who had been weaned on the classics and the tales of military usurpers such as Sulla and Julius Caesar, all generals became objects of suspicion. [...] Because the 'Nord' had been Dumouriez'[s] army, its officers fell under particular scrutiny. The representatives with the 'Nord' were issued specific instructions to root out any who might have been Dumouriez'[s] accomplices. In such an atmosphere honest mistakes could easily be misconstrued as treasonous acts, and treasonous acts could bring execution to those who committed them. (pp. 48-49)

This also explains why so many specific accounts of representatives using disproportionate measures are found in memoirs of soldiers from the Nord, the Sambre-et-Meuse, and the Rhin-et-Moselle. By contrast, when recalling Toulon, Victor also mentions the representatives in his Memoires inédits, calling the representatives acclaimations "frenetic" and critizing revolutionary ideals as "bellicose" (p. 13), but his descriptions of the representatives are markedly less acerbic than Soult’s or Saint-Cyr's. The threats of the representatives of the Nord succeeded in creating an atmosphere of fear among the army cadres in the northeast, but whether they were uniformly as formidable across France is another question.

If the representatives did threaten officers with death, the fact remains to see if they carried it out, especially if there is printed evidence. Curiously, in Saint-Just’s oeuvres, I could only find two instances of dismissals and two instances of arrests, and none of them exhibit the bloodlust contemporary memoirists associate with Saint-Just. The first, dated 19 floréal/8 May, is this:

The Representatives of the People to the Army of the North decide that citizen Plaideux, general of brigade of the Army of the North, will retire to the Ministry of War, the Army of the Nord not having for the moment any need of his services. (p. 410)

So what happened to Plaideux? According to Georges Six’s Dictionnaire biographique des généraux et amiraux français de la Révolution et de l'Empire : 1792-1814, vol. 2, he was additionally issued an arrest warrant on 21 April of the same year. However, on 14 August, he assumed detachable command at Béthune, and on 6 November, he took up the post of general of brigade in the Laclaire devision (p. 318). In other words, he was back to work in three months. No executions here.

Saint-Just issued the other dismissal on 1 messidor/19 June:

Considering the citizen Capella, chef de brigade, commanding the 132nd demi-brigade, had neither the knowledge nor the energy necessary to fill a post so important; That this demi-brigade, composed of bataillons who have acquired in the war the highest reputation, has been exposed to see its glory eclipsed by an unable leader and his character, notably on the day of the 28th of the previous month, under the very eyes of the Reperesentants of the people; We decree that the citizen Capella will cease to be employed. He will present himself to the War Ministry his service records to obtain his retirement. (p. 433)

Next, the representatives promote Pouchin, captain of the 4th battalion of la Manche, in place of Capella, and orders that “all officers, non-commissioned officers, and soldiers acknowledge him and obey him according to military laws. Just like in Plaideux’s case, nowhere does Saint-Just order the execution of Capella, and despite Capella's incompetencies, Saint-Just does not sentence him to the extrajudicial military tribunal where he would have met certain death.

As for the arrest warrants, such as the one on 29 priarial/18 June, Saint-Just justifies them thus:

The Representatives of the People to the Armies of the Nord, the Moselle, and Ardennes, On the account given to them by the general of division Kléber that, yesterday, the second battalion of the Vienne fled shamefully before the enemy, during which the flags of the other battalions from two divisions of the Army of the Nord flew on the road to victory, and that it ignored ther voice of the general who called him back to his post; Considering that the crime cannot be of the entire battalion, because the bravery and the hatred of tyrants exist in the hearts of all the French and that, when a troop leaves their battle post, the cause is in the cowardice of officers or in the negligence of those tasked to maintain the discipline and to shape the soldiers they command to have a love of glory, which consists of braving the dangers of war and to conquer or to die at the post that the fatherland has conferred them; Decree that the chef de bataillon and all the captains of the second battalion of the Vienne will be dismissed and put under arrest; They will be replaced on spot according to the law. The chief of staff will execute the present decree. (pp. 432-433)

While this may seem extreme, knowing Saint-Just’s fanatic reputation, we might have expected him to force the representatives and generals to put the whole battalion to death. Moreover, this decree shows that generals in high command "tip off" the representatives on military indiscipline for them to correct, which I am sure deserting during a victory would count as. That said, the civilian respresentatives' attempts to rectify this military indiscipline may have caused irritation among the officers.

Notice that the proclamation also does not condemn the rightfully arrested to the military tribunals, as the Representatives have promised earlier, and that for the second time, these dissmisals and arrests decree all procedures to be done in accordance to the law. It is far cry from the disregard the representatives seem to have for the law and for the words of the generals, as they say their declaration of the military tribunal. And when prisoners are to be tried, it is also according to "the law", as in this proclamation on 1 messidor/19 June.

The Representatives of the People to the Armies of the Nord, the Moselle, and Ardennes, Approve the nomination made on the battlefield by the general of division Marceau of citizen Verger, captain of the carabiniers, to the rank of chef of the 1st battalion of the 9th demi-brigade of light infantry, and decree that the officer who commanded that battalion at that time and who refused to rally it despite the orders of the general, will be dismissed, put under arrest, and brought before the military commission established at the headquarters of the combined armies, to be judged in accordance to the law. The chief of staff is charged with executing this present decree. (pp. 434-435)

This proclamation raises a few questions. Is the military commission the same as the military tribunal, and if it is, is it following the laws of decree that the Representatives proclaimed on 15 floréal/4 May? If all the above are true, and Verger was found to be an agent of the enemy, then this is the only instance that the military tribunal had their hand in an execution.

Even so, Verger was not arrested for not being patriotic enough, but due to direct insubordination on the battlefield, as Marceau's actions indicate. Of course, Marceau may not have wanted to condemn his captain to arrest even with his insubordination, or one could argue that the representatives forced Marceau to denounce Verger. We would be here all day if we were to debate how much the representatives' paperwork differed from their historical actions. The bottom line is that despite all the threats the representatives have made about giving disobedient soldiers a prompt death, very few of the arrested individuals were made to appear before the military tribunals or were sentenced to death on paper. Furthermore, all the arrestations appear to be for actual offenses, even if said arrests are disproportionate to the offences.

Because of the comparatively lenient nature of the arrest warrants in Saint-Just's Œuvres, I am inclined to think tales of Saint-Just's ruthlessness, while not unfounded, are greatly exaggerated. Feel free to add any additional information.

The story goes like this: So Danaus, a prince of Egypt, had fifty daughters called the Danaides. His twin brother Aegyptus had fifty sons (!!!) and he demanded that his sons should marry his brother’s fifty daughters; Danaus was appalled and fled to Argos but Aegyptus and his fifty sons followed them and demanded to marry the Danaides.

Danaus agreed to the proposal but secretly instructed his daughters to kill their husbands on their wedding night (slay). All the daughters followed through except for one, Hypermnestra, who didn’t do it because her husband, Lynceus, honored her wish to remain a virgin.

Danaus put her on trial for the crime of disobeying her father. However, Aphrodite intervened and defended Hypermnestra, who then was acquitted; Later the princess dedicated an image to Aphrodite Nikephoros (Bringer of victory). Lynceus and Hypermnestra went on to create a dynasty of Argive kings.

so basically Argos’ whole royal lineage only existed because Aphrodite saved their first princess from being punished by her father !!! she’s so mother I love her

La Fayette's Opinion on Court Martials

Tl;dr: La Fayette was much opposed to court martials.

This was intended as a post about La Fayette’s opinions on the death penalty and the reform of penal law – however, I think it is worthwhile to have a look at his opinion on court martials and the different systems used by different nations (France, England, America and to some extend Poland)

Now, La Fayette expressed his opinion for the first time in a written document that we knew of in a letter to George Washington on January 13, 1778. Although that is his first time expressing such notions to Washington, by the points that he raises it is evident that he has held these believes for some time. The trigger for La Fayette writing this letter was the court martial of two of his subordinate officers:

At the same [General] Court held 6th instant Captain Flagg charged with “neglect of duty 1st in suffering the Marquis de la Fayette, when Major Genl of the day to come in the night to the center of his Picquet, without being stopped or challenged; 2nd for permitting his sentries to have fires in his sight” was tried and acquitted by the unanimous opinion of the court. The Commander in Chief approves the sentence.

At the same Court held 7th instant Captn Laird, charged with “Neglect of duty, in suffering the Major General of the day to surprize him at his picquet in the night”—was tried & found guilty and sentenced to be dismissed from the service. The Commander in Chief approves the sentence.

La Fayette wrote his letter the same day and described the situation as follows:

There were two gentlemen, same rank, same duty to perform, and same neglect of it who have been arrested the same day by me—as I went in the night around the piquets I found them in fault, and I gave an account of it the next day to your excellency—you answered that I was much in wrong not to have had them relieved and arrested immediately—I objected that it was then very late for such a changement, and that I did not know which was the rule in this army, but that the gentlemen should be arrested in that very moment—the last answer of your excellency has been, “they are to have a court martial, and you must give notice of it to the adjudant general”—therefore major nevill made two letters in order to arrest them, one for having been surprised in his post and the other, for the same cause and allowing his centrys to have fires which he could see in standing before the picquet. I give you my word of honor that there was not any exageration.

Beside his recalling of the situation, it can also be noticed that La Fayette was unfamiliar with the system of court-martials in America and used to different proceedings from his time in the French army.

Before we address La Fayette’s grievances with the court martial system in the Continental Army in general and with these cases in particular, here is his account of the proceedings in France:

(…) in france an officer is arrested by his superior, who gives notice of it to the commanding officer, and then he is punished enough in being deprived of going out of his room in time of peace, of doing his duty in time of war—no body knows of it but his comrades—when the fault is greater he is confined in a common room for prisonner officers and this is much more shamefull—notice of it is immediately given to the general officer who commands there—that goes too to the Kings minister who is to be reimplaced here by the commander in chief—in time of war it goes to the general in chief.

Soldiers are punished the same or next day by order of proper officers, and the right of punishing is proportionate to theyr ranks. but when Both officers and soldiers have done something which deserves A more severe punishement, when theyr honor, or theyr life, or theyr liberty for more than a very short time is concerned, then a court martial meets, and the sentence is known—how will you let an unhappy soldier be confined several weeks, with men who are to be hanged, with spies, with the most horrid sort of people, and in the same time be lost for the duty, when they deserve only some lashes—then almost no proportion in the punishements.

Now, his first problem were the punishments – or better; lack thereof. You recall that Captain Ebenezer Flagg was acquitted:

now I See in the orders the less guilty punished in a manner, much too severe indeed, and dismised from the service (it is among all the delicate minds deprived of his honor) when he was only to be severely reprimanded, and kept for some time under arrest—but it can be attributed to a very severe discipline.

This acquittal was not only bothersome for La Fayette because Captain David Laird, who committed a less serious crime in La Fayette’s eyes, was so harshly punished. Part of the problem laid also in his perception of a gentleman’s word of honour:

what must I think of the same court when they unanimously acquit (it is to say that my accusation is not trüe) the officer who joins to the same fault, entirely the same, this of allowing his centrys to have fire in his own sight—for in every service being surprised or being found in the middle of his picquet without any challenging or stopping centry, as major nevil riding before me found him, is entirely the same thing—and mjor nevil riding before me when I was busy to make a centry pull off his fire, can swear that such was the case with that officer—he can do more than swearing, for he can give his word of honor—and I think that idea honor is the same in every country but the prejugées are not the same thing—for giving publickly the best of such a dispute (for here it becomes a trial for both parties) to an officer of the last military stage against one of the first, schould be looked on as an affront to the rank, and acquitting a man whom one other man accuses, looked upon as an affront to the person—it is the same in poland for count de pulaski was much affronted of the decision of a court martial entirely acquitting Colonel molens—however as I know the english costoms I am nothing else but surprised to see such a partiality in a court martial.

We read that La Fayette was not alone in his perception here and that other foreign officers, in this case Kazimierz Pułaski, were of the same opinion. His comment on the “english costoms” will be of some important later on.

But beside the critic he mentioned specifically in context of this affair, there were still more general points of criticism that La Fayette had – there were three points in total:

how is it possible to carry a gentleman before a parcel of dreadful judges at the same place where an officer of the same rank has been just now cashiered, for a trifling neglect of his duty, for, I suppose, speaking to his next neighbour in a maneuvre, for going into a house to speack to a pretty girl, when the army is on his march and thousand other things—how is it possible to bring to the certainty of being cashiered, or dishonored, a young lad, who has made a considerable fault because he had a light head, a too great vivacity, when that young man would be perhaps in some years the best officer of the army, if he had been friendly reprimanded and arrested for some time, without any dishonor. the law is alwaïs severe, and bring with it an eternal Shamefull mark—when the judges are partial as in this occasion, it is much worse, because they have the same inconveniences as law itself. in court martials men are judged by theyr inferiors—how (mutilated) to discipline I do’nt want to say—the publication exposes men to (mutilated) despised by the least soldier—when men have been before a court martial they schould be or acquitted or dismissed—what do you think can be produced by the half conndemnation of a general officer—what necessity for all the soldiers, all the officers, to know that general maxwell has been prevented from doing [h]is duty by his being drunk. Where is the man who will not laugh at him if he is told by him you are a drunkard and is it right to ridicule a man repectable by his rank, because he drank two or three gills of rum. there are my reasons against court martials, when there is not some considerable fault to punish—according to my affair I am sorry in seeing the less guilty being the only one punished however, I shall send to court martials but for such a crimes, that there will be for the judges no way of indulgence and partiality. With the most tender respect I am Your excellency’s the most obedient servant

While La Fayette sounded almost a bit rebellious in his last sentence, it was not that he was entirely against court martials, he simply wanted them reserved for more serious offenses.

your excellency will certainly approuve my not arresting any officer for being brought before a court martial, for any neglect of duty, but when they will be robbers, or cowards, or when they will assassinate, in all when the[y] will deserve being cashiered or put to death.

The American system of court martials was molded after the English system and La Fayette was not quite happy with that either. Again, in the same letter to Washington from January 13, 1778 he wrote:

Since I picked the letter so much apart, I will put a full and continuous version beneath the cut. :-)

Washington was not the only person, nor this the only incident where La Fayette expressed his displeasure about court martials. He wrote in a letter to Henry Laurens in his official position as President of Congress on March 20, 1778:

There as been a court martial for desertion which I din’t approuve of, but as among other men I have found sentenc’d of death, I beg from Congress to be empowered to relieve the man.

Despite being against court martials, La Fayette was naturally involved in a number of trials one way or another. He for example took part in two famous court martial cases, the cases of Charles Lee and Major John André. In Lee’s proceedings, La Fayette was a witness and wrote to Henry Laurens on July 6, 1778:

You have heard good deal, I dare say, of the court against Gal. Lee. I am very unwillingly an evidence in it but am happy enough as to have nothing material to say. This Gal. Lee is very much prejudic’d in favor of his english nation. If he is condemn’d, certainly he must be guilty of some thing very ugly.

Even in this short abstract La Fayette clearly states his opinion of General Charles Lee. It was not a very high opinion. He thought that Lee had acted badly during the battle, that he was prejudice, and that Washington was in the right when giving him a dressing down. Still, La Fayette was not in favour of the court martial and much resented being a part of it. We can see that his aversion for court martials, was not based on personal sympathies. He rejected these proceedings no matter the circumstances or the person accused.

Another great, but more complex, matter was the court martial of John André. La Fayette sat from September 29 to September 30, 1780 on the court martial of John André and was therefore among the men who found him guilty. He wrote to the Vicomte de Noailles (the husband of his sister-in-law) about his role in the proceeding on October 3, 1780.

But what has truly afflicted me is the necessity of hanging the adjutant general of the British army, a charming man who conducted himself throughout, and died, like a hero. This severity was necessary; the enemy acted very stupidly on this occasion, and since they lost that unfortunate man, the soul of their army, they have not written one letter that had common sense. Andre was executed yesterday. General Clinton’s anger does not frighten us, but this man's death, although inevitable in my opinion, left me with a feeling of sadness and respect for his character. I truly suffered in condemning him; but he was an officer under disguised clothing and name, passing within our posts with papers full of intelligence for the enemy, and he himself did not hesitate to recognize himself as a spy.

La Fayette’s aversion to court martials meets here his personal sympathy and respect for John André and his opinions (although they were still very much developing at this point in time) about the death penalty.

Out of the recorded 3315 court martials recorded in the continental army during the War of American Independence, La Fayette was involved in a number of them. We dissected the cases of Flagg, Laird, Lee and André. A forage master under his command was tried on February 19, 1778:

At a General Court-Martial whereof Col. Cortlandt was President (Feby 19th 1778) Mr Edward Bennett Forage-Master in the Marquis La Fayette’s division tried for repeated neglect of duty in suffering the horses of the division to remain three days without Forage when there was Forage in the General Forage yard, and all the divisions in the Army drew, for neglecting to draw hay when to be got and for trusting to others what he should himself perform by which many horses in the division have perished and the whole of the teams rendered unfit for duty. (…) The Court are therefore unanimously of opinion that Mr Bennett has been neglectful of his duty in not getting forage for the horses of the division to which he belongs when it could have been procured whereby many of them have perished for the want of it, being a breach of Article 5th Section 18th of the Articles of War and they do sentence him to be dismissed from his employment in the forage department.

He also ordered the court martial of Lieutenant William Mills on September 15, 1780:

At a division General court martial the 15th instant by order of Major General Marquis de la Fayette, Colonel Swift President Lieutenant William Mills of Colonel Gematt’s regiment of Light Infantry was tried for “Disobedience of Orders” and unanimously acquitted.

He further ordered a court martial for Captain Wilkin on September 12, 1781:

At a General Court Martial assembled at Williamsburgh September 12th 1781 by order of Major General the Marquis de la Fayette Colonel Vose President—Captain Wilkin of Colonel Stewarts Battalion of the Pennsylvania line, charged by Col Stewart with riotous behavior in his tent at an unseasonable hour of the Night; with disobedience of orders in not desisting when ordered so to do by the field Officer of the day through the Adjutt Captain Vanhorn and for using language and conduct subversive of good order and Discipline, was tried and acquited.

The Commander in Chief approves the Opinion of the Court. Captain Wilkin is released from his Arrest.

La Fayette also was asked by General Wayne to approve a verdict by a court martial ordered by Wayne himself. The soldier in question, James Grant, was from Virginia and La Fayette was popular with the Virginias and Wayne not. Wayne wrote on August 10, 1781, the day after Grant’s trial:

Inclosed is the proceedings of a Genl. Court Martial. Was it held on a soldier belonging to the Pennsa. Line I should not have the least difficulty or a moments hesitation in Confirming it because if this Culprit should pass with Impunity-it may open a door to worse [occurrences?]. But as it is a private of the Virginia Line I beg leave to commit it to your Decission.

Grant was found guilty of shooting Captain Abraham Kirkpatrick whom he allegedly found in bed with his wife.

This list is by no means intended to be conclusive, there were probably many more cases La Fayette was involved in, these were just the ones I could present after a relatively quick search. This is more meant to give you a felling for La Fayette’s behavior in such situations.

dear general I Schall make use in this particular instance of the liberty you gave me of telling freely every idea of mine which could strike me as not being useless to a better order of things. There were two gentlemen, same rank, same duty to perform, and same neglect of it who have been arrested the same day by me—as I went in the night around the piquets I found them in fault, and I gave an account of it the next day to your excellency—you answered that I was much in wrong not to have had them relieved and arrested immediately—I objected that it was then very late for such a changement, and that I did not know which was the rule in this army, but that the gentlemen should be arrested in that very moment—the last answer of your excellency has been, “they are to have a court martial, and you must give notice of it to the adjudant general”—therefore major nevill made two letters in order to arrest them, one for having been surprised in his post and the other, for the same cause and allowing his centrys to have fires which he could see in standing before the picquet. I give you my word of honor that there was not any exageration.

Stone's documentation of the case: 6:00, end of session: Ms.Pom entered the court with a seemingly genuine remorseful front. She began alongside her attorney, Mr.Edgeworth, pleading not guilty. The suspect began her case with the same remorseful attitude-reminding most of a scared child. By past personal experiences and multiple attempts to interrogate the suspect, she seems to genuinely believe this. With Mr.Phoenix's questioning, however, the two have seemed to trade confidence levels, as Ms.Pom has seemed to take notice that the questioning attorney was a game protagonist, himself. However, this trade of confidence has caused her to admit the murders of Mario Mario, Conker T. Squirrel, Bubsy Bobcat, Kirby, Taizo Hori, Tyrone Tasmanian Tiger, Olgilvie Maurice Hedgehog, Banjo Bear, Kazooie, Bug-exclamation point... Link-...Link? And Crash Bandicoot... *ahem* Bunch of circus freaks *cough* Ms.Pom has been sentenced to death row for her transactions. Her defendant, Mr.Edgeworth, only seems to be distracted by a missing pen. 7:30, update 2: The building is currently on lockdown. No one is permitted to leave the premise until the whereabouts of Ms.Pom and Mr.Wright are verified.

Character descriptions:

Pom Pom:

Pom Pom is a virus/glitch formed by the scrapped side-scrolling arcade game from the early 90's “Pom-Pom Panic”. Pom Pom (the main character of Pom Pom Panic) for whatever reason gained sentience halfway during the game’s development. The game was cancelled halfway because the publishing company thought it was too bizarre of a concept and mascot character to gain interest. Pom Pom heard of the news and took it way too personally, as she literally cannot fathom why someone would think she’s ‘bizarre’-even to the point of getting ‘axed’. Prompted by the ‘poor judgement’ Pom Pom went rouge-breaking from her game to ‘axe’ any ‘approved’ game mascots/characters she thought could count as ‘bizarre’ like her.

Power Officer Stone:

Stone is the amalgamation of a couple things, exactly what people aren't sure of, but it's safely assumed that he's a mix between scrapped virtual PSA mascots, an antivirus/piracy program, and the anti drug campaigns they used to put in arcade games. Stone is the embodiment of anti piracy screens and uses all of his time to prevent virtual crimes and viruses. He also can duplicate himself and multitask. However, because of his frustrations against the fact that he can't really punish pirates in real life, he often bounces the punishment to the closest playable character. For that, he's infamous amongst most virtual realms.

THE FOGGY APPEARANCES MASTERPOST

So I decided, after literal years of relying on places like the marvel wiki and comicvine to look for and double check Foggy Nelson's appearances throughout the marvel universe, to go and make a comprehensive list of his appearances outside of the main Daredevil title, counting Daredevil limited series and one off stories, along with cameos and alternate universes. The intention was to streamline the process for myself so i dont have to scour through pages and pages every time I wanna remember which comic that one thing happened, but hey, why not make the process of finding comics easier for people who aren't as deranged as I am? So here I made this post, from a real Fog-head to other Fog-heads out there, listing every issue outside of the Daredevil title (as it is more straightforward to find him, and extremely long to type on this list) he appears in, from barely there cameos to central roles, sorted by whether they are set in Earth 616 or not, and in no particular order. This is simply a list to serve as a guide to find him, it is not a curated list so the quality varies wildly, but I hope you're all as curious as I was to find all the most obscure and niche Foggies out there. I've lost track of what migraine day I'm on, but Trigun Book Club persists and so shall I.

Stream-of-consciousness thoughts for TriMax Vol. 13, Chapters 4-6 below.

Chapter 4: Black

Voiceover Narration: Little did Livio know, but both the hat and the cape provided him with a +10 bonus to strength in addition to the moral boost. Someday, he would open up the stat screen for both and discover this, and then he would weep grateful tears that those who had so little gave him so much.

Oh, Elendira's got her own stat boost outfit, I guess.

I love how much tone she has in her voice. Between her body language and the translation, she's just a very easy character to hear in your head.

Ok, this panel is badass.

Ooh, she actually landed a hit on him. Hasn't done that in a bit.

Why's she sizzling? Is it because she's on fire right now?

(Also, she might be in full badass mode, but goshdarnit, she better not seriously injure my Livio. He's important to me and needs to live!)

Aaaand we're back to Legato's monstrosity.

Dude. He has to save some for fighting Knives, dummy. He's not Gojo utilizing Limitless and being able to just go forever. He's going through his Last Run. There's a hard stop to his power and it's coming up quick.

Hahahahaha, these poor guards. Space ships are, like, history bordering on mythology nowadays. They'd be more mythological if their bones weren't scattered across the planet. Seeing an actual functioning one that came from actual space would be quite something.

That's RIGHT, Luida's the one in charge!

Vance? As in advance? I mean, I know it's an actual name, but it's not a very common one and Nightow really seems to like just making names up, anyway....

Ok, so... Knives has always been a bit OP, but what I'm gathering from the Earth Fleet presentation is that this is a bit ridiculous even by the standards of a culture used to Plants.

Ok, I already have questions about how they know about any particular individual. I'm guessing they gleaned a lot of relevant information out of the remnants of Domina, but yeah.

Goshdarn, of course they were hoping to find Vash....

Dramatic Legato pose!

Man, why'd he get so sweaty all of a sudden? That can't be comfortable.

Awww, Legato's little toy got wrecked. TBH, that looks more like Knives' work than Vash's... but that's only because it's hard to tell the curvature of the cut. Knives tends to do straight cuts while Vash destroys things in orbs.

Ugh, Vash might look badass, but he does not look good. Someone get him a sports drink or something to perk him up. Do Plants love electrolytes in this world?

I wonder who the other two were. Knives and pre-bagworm Legato?

Uh, oh. Guess who's back. You done threatened Livio too much, Elendira.

Chapter 5: Battle of the Mystics

Yeah, Raz doesn't fuck around....

It's weird seeing Raz with short hair. Like, Livio with short hair? Not as cool as if he'd cleaned it up but kept it long, but it was so uneven I get it. Raz with long hair and that undercut? Good for his level of chaos. Short-haired Raz? Just feels too restrained for him.

"Some dumbasses," huh? That's a rude (but perhaps not inaccurate) way to refer to Wolfwood and Vash.

I do appreciate how much more intense and unhinged Raz is compared to Livio. Even Elendira seems a bit taken aback by the mood switch in her opponent.

Oh, that's right. He's used to wielding full-out punishers rather than the double-fangs.

He's gonna burn through ammo so fast using them like that. It's a good thing the guns in this series have ammo in plot amounts.

LOL, Elendira is already sick of Razlo's shit.

Uh. That's a lot of nails. I don't like this. She's being mean to my boy.

Oh, gods. I'm not sure even he can survive this.

OH GOOD IT WASN'T REAL. Dammit, Nightow. Don't scare me like that.

Oof, he's still not in good shape. :/

Chapter 6: Tag-In A Person

I feel like... Livo and Razlo are gonna tag-team this fight somehow....

Mmm, seems like Raz can't deal with Elendira's bloodlust.

Elendira! He needed that leg!

Oof, tiny Wolfwood memory....

The way Elendira says this makes me think she has some experience being on the receiving end of this herself.

Look at him. Pumped full of nails again, but still going. He's a freaking machine.

Ok, I love how Nightow has used the dialog bubble to let us know that Livio is back in control here. It's a small thing, but excellent use of the medium.

I love this conversation between Livio and Razlo. It's Livio making peace with himself, with him recognizing his alter and... sort of validating Razlo's existence, I guess? That Razlo is him and isn't him, and that's ok, and they are part of a tandem structure?

Oooh, are they both fronting? Or... like... Livio's fronting, but Razlo's kinda there, too. I'm not sure how much that works with DID, but it's interesting from a narrative perspective.

Again, wonderful bit of paneling here.

Hahahaha, he didn't even bother to remove the nails. I realize this is a way of telling us that someone is a badass, but... like... having holes in your muscles and/or tendons seriously mucks with your range of motion. If you have a healing factor, get that shit out of the way so it can kick in. Otherwise, you're limiting yourself pretty severely. Like, he shouldn't be able to stretch out to his full wingspan with stuff popping through his back like that. Ok, I'll stop. I know I shouldn't expect realistic anatomical consequences in this series.

Wait, where's Vash? I'm worried about babygirl....

Heheheheh, backwards-firing gun trick shot. Again.

Oh, this is lovely. He's fighting right now with a balance neither side of him generally displays.

Ooh, he got a solid hit on her.

Heheheheheh, mind Razlo still has the mohawk. As he should.

Elendira's got her priorities straight. Kill first, ask questions later.

There's something very satisfying (and maybe very important) about Livio praising Razlo. Not just leaning on him when he's afraid, but honoring Razlo's skill and technique and complimenting him on it. Raz wanted so bad to be needed and to be praised, and now he's getting the praise from probably the person he needed it from the most.

Wait. Wait, is Razlo going somewhere??

What's coming next that's so bad that Raz isn't sure he can keep up with it??

trimax vol 13 random thoughts (ch 5-9)

part 1 here!

chapter 5:

okay, it took me way longer than it should have to figure out what happened in this scene, lol. razlo gets behind elendira and blocks her nail gun with the nail that's already in his body which jams her gun and pushes the nail further into his torso which takes them both by surprise.

"some dumbasses"?? do you mean wolfwood and vash?? LOL

come on, come on, come on!!! he's so cute, lol. he's like a dog who wants to play.

i love watching razlo fight!!! it's so fun seeing him fight a different way due to not having his punishers/third arm anymore. he's having so much fun too, it's infectious~

UNTIL ELENDIRA USES A PSYCHIC ATTACK ON HIM. JESUS CHRIST. THAT ONE ALMOST HAD ME.

chapter 6:

i'm sitting here trying to articulate my feelings about livio and razlo and i can't, really... :') livio feeling so bad and apologizing that he has to rely on razlo so much, razlo doing his best to encourage livio... they really care about each other a lot. it's very sweet. i care them. :(((

oh this is so very much not how DID works but it's both cool and important to their character arcs so it's FINE!!!! it's fine

huuuhhhmmmmm something something symbolism in livio's guns being reversible and livio and razlo working together, two as one... is this anything? am i connecting any dots here?

they were able to bring elendira to her knees with their teamwork!!!!

chapter 7:

uwaaahhh! young livio flashback!! this is where his twinky stampede self came from i guess. i hope season 2 gives us a beefier version-

...wait. wait, wait, wait, wait, wait wait wait. hold on. speaking of stampede. give me a second.

*returns 30 minutes later* HUH. INTERESTING. so stampede shows us livio working hard in EoM to catch up with wolfwood, but in the manga, it's all but outright stated that he's trying to catch up with razlo.

sorry i'm just fascinated by the tristamp/manga differences and seeing younger livio doing pushups reminded me (stamp!livio does pushups the same way!!)

we're not supposed to know that razlo exists yet in tristamp; i wonder if or how season 2 is going to reframe any of this. it's not like i dislike livio and wolfwood's relationship in stampede!! i think it's really sweet, introducing livio into ww's story earlier is a good move, and livio joining EoM to catch up with ww makes everything in the relevant episodes more emotional. but the relationship between livio and razlo is just as important!!

razlo encouraging livio is SO cute, uwaaaahhh...

elendira, killed by her own nail... oh girl... my beloved... i did not expect her to live but i'm still sad she's gone. what a fantastic fight though. might be my favorite fight in this manga.

also livio's gonna have an interesting time trying to get up and get her off of him once his limbs regenerate... uh... if they can regenerate? i'm assuming they can...

i am gonna fucking CRYYYY... calling him by name... wwwaaaaahhhhh...

he would be so proud of you, livio!!!! WAAAAHHH!!!

okay, time to cut back to my other faves having their own battle.

actually i do wonder how measuring time works on this planet. like, everything seems to be measured the same way it is on earth, so does noman's land also have 365 days in a year and 24 hour days?

he's so cute, i am holding him gently in my hands.

knives is so mean... to be just a tiny little bit fair to him, i too would be low on patience if my brother just blasted me with a death beam and someone suddenly started handling my guts that were hanging out. but he's so mean!! i feel bad for legato!!

i AM surprised that knives is still conscious... and that he's still mostly intact. like his guts are hanging out but it looks like his legs and arms (or at least one arm) are still attached, and he's still got. y'know. most of his skin. certainly more intact than his stampede self, lmao.

vash, honey, what on earth makes you think he plans on living through this fight any more than you are. :')

chapter 9:

OH BOY, HE'S FERAL!!! truly, he is going out in a blaze of glory just like he wanted. i wouldn't expect anything else from him at this point.

ahhh... stampede!legato talks a lot about discarding emotion in favor of devotion. but emotion and devotion are intrinsically linked. legato is a pretty emotional person, he cries a lot and yells a lot... as long as he can express his devotion to knives, he feels like he's fulfilling his purpose, so he's happy... i'm glad he's having fun at least... :')

WAAAAHHH VASH IS REMEMBERING WOLFWOOD NOW... his face is not quite visible but... vash is remembering wolfwood's words because he's thinking he really is going to have to kill legato to end this fight... killing legato just like in the 98 anime...

i get caught up in the action, but every time they bring wolfwood up i realize how much i miss him...

this panel fucks.

i love watching legato go fucking crazy fighting. i wanna see this fight animated so bad :''')

when i read the top panel, i was like, "because of knives, right?" then i read the bottom panel... ahhh... not just knives... every plant... it's a good thing tristamp established this relatively early because we don't really see vash doing this in the story lol

how will knives be defeated? can humanity survive? will livio's limbs regenerate? and most importantly, HOW WILL VASH GET HIS WILL TO LIVE BACK?!?!

Trimax Vol 13 Ch 5-9

Part 2 of my thoughts on volume 13! In which I manage to get very emotional about Vash, Livio, Wolfwood, and even Legato.

Ch 5

When Livio is truly in danger, when he’s really scared, that’s when Razlo comes out. He never actually left! Razlo is always going to be a part of Livio. The question is whether Livio will be able to communicate with him, rather than let him have complete control to do whatever he wants.

Currently, it looks like Razlo is 100% in control because I can’t imagine Livio fighting like this. Purposefully putting himself in the way of Elendira’s gun so it jams, but also hurting himself more in the process? That’s a reckless thing to do, even with LR’s regeneration abilities and from what we’ve seen of Livio’s fighting skills, he’s very cautious. He’s not afraid to take a hit, but he certainly wouldn’t throw himself in front of one, even if it would get him the advantage. Sometimes, he fights like he doesn’t have those regeneration abilities.

Oh, I didn’t notice that earlier! Those smaller semi-automatic cross-shaped guns are exclusively Livio’s weapons. Razlo, since he’s the Tri-p of Death, only fought with Punishers. But there’s something symbolic in him fighting with Livio’s guns now. They’re much lighter, easier to move. But for Livio they don’t carry the same burden of guilt that the Punishers do.

Elendira’s true power appears to be some kind of psychic projection/manipulation that takes advantage of a person’s natural instincts/bloodlust. If I’m understanding this correctly.

Oh well, that’s horrifying. I remember when I first read this, I was so distraught because I thought Livio was dead! But then you realize, he’s not! Elendira’s projecting a vision on him.

I also can’t tell if the way Elendira’s body, specifically her hands, are elongating is part of the vision or if she’s actually morphing a little. Either way, that’s so messed up.

You know what that reminds me of? When Wolfwood had that horrifying vision of being torn apart after he brought Vash to the Ark way back in volume 7. Who did he happen to be standing in front of when it happened? Elendira. But he assumes it isn't her, probably because he doesn’t know much about her. He thinks it was probably Chapel because he’s the one who has a vendetta against him, but we never see Chapel doing anything like that again or exhibiting any sort of power like that.

Why would Elendira do it then? As we know, Elendira likes to mess with people. She ultimately doesn’t care about Wolfwood’s betrayal of the Eye, but she thinks it’s fun to torment people. Just look at how she treats Legato all the time. Now, she actively hates him, but still, I feel like she wouldn’t pass up an opportunity to mess with Wolfwood who she also seemed a little antagonistic with, if not in a slightly, let’s say, nicer way than she is with Legato.

Ch 6

Elendira is much more powerful than either Livio or Razlo. Her psychic abilities are keeping him down and she’s constantly beating on him to keep him from regenerating too quickly. Much like Wolfwood was when he fought Razlo. Which is an interesting parallel to draw right now.

Is that…Wolfwood’s last vial? I wonder why it’s making an appearance now. Is it related to Elendira’s comment about how Razlo has never been so thoroughly defeated? Because the vial reminds us that he was, by Wolfwood. Who gave everything up in order to do that and save Livio. Is that what gives him the sudden will to fight against Elendira’s control?

Oh, and that’s when Livio switches back! He regains control because he remembers who he’s fighting for and why he’s doing it.

The switch was involuntary. It was a fall back to old ways, to let Razlo do the hard stuff. And again he apologizes to him for it, for putting him into a tough situation, especially when he promised he’d be able to handle the tough things on his own. But at the same time, I don’t want Livio to think he can’t ever ask for help, even if it’s from his other personality. Because I do think they can help each other, if they figure out how to work together.

No, Livio!!! He’s never felt this kind of pain before because he’s always had Razlo there to protect him and take the brunt of it. But he’s not weak. Everything he’s done up until now shows that. It took a lot of strength to get where he is and I wish he could see that.

But Razlo!!! He’s protecting Livio again, but in a different way. He’s not letting him mope (in very Razlo fashion). He tells him to get up and keep going. He helps him, and this time, they fight together, each one using their strengths to aid the other. They’re starting to work as one.

All I have to say for this part of the fight is YEAHHHH, GO LR!!!!

When they fight together, they’re unstoppable! Razlo’s reflexes with Livio’s skill make for one hell of a fighter.

Ch 7

So far, Livio has apologized to Razlo twice for what he put him through in order to survive, but now…he’s also thanking him! By saying I owe you, he’s acknowledging how much Razlo has helped him and gotten him through some really tough times.

Training montage! Livio is trying to “keep up” with Razlo and his prowess, not realizing that since they exist in the same body together, they can share that knowledge. Up until this fight, he’s treated Razlo like a separate being rather than part of him.

GOOOOO RAZLO. HYPE UP LIVIO!!!

He’s so right. They’re a duo, a team! If Razlo’s the strongest, so is Livio

Hey, uhhh did Elendira rip Livio in half? And cut off his arm? That’s…concerning. And there are entrails everywhere, yikes.

I’m assuming that tank-thing is the nuclear weapon that Elendira has been after? Her back-up plan for the destruction of the world in case Knives fails.

Truly, Livio is the only person who can stand against Elendira because he just keeps on regenerating from injuries that would have killed other people ten times over.

But also, it’s because Livio is fighting for something and he’s not doing it alone. He’s doing it with Razlo, rather than by himself. And, in a way, Wolfwood. Wolfwood’s final gift to Livio was that vial, and Livio will use it to survive this and kill Elendira. An interesting parallel to Wolfwood using the vials to give himself the strength to finish the fight and get what he wanted, but die in the process.

“To me, to Razlo, and to him.” The way these words are arranged on the page pack a punch. You’re not expecting the “to him” and even without saying his name, we know who Livio is talking about. Wolfwood’s presence is so strong even though he’s gone. He really does haunt the narrative.

Ch 8

So question: can Livio regrow limbs like a starfish? Because his arm and leg are smoking in the way it does when he heals. But does it heal as a stump or does it regenerate? I guess that question will be answered when we (hopefully) see him again.

I just realized Livio impaled Elendira on the nail that was stuck through him. That’s just…wow. I need to go back and reread that fight because I can’t remember how or where he got it.

Oh…this is the first time in three volumes anyone has said Wolfwood’s name, and it was Livio. And he called him Nicholas!! We’ve rarely, if ever, seen him referred to by his first name so this makes me feel like I’m chewing on glass.

Livio just wants Nicholas to be proud of him, to see that he’s living up to his sacrifice and doing good. I’m gonna cry.

How does Legato know Elendira is dead? Is this a return of Legato’s brief psychic abilities that were never mentioned again?

I know Vash is burning himself out doing this, but it says a lot that his powers have been manifesting as defense mechanisms recently, and incredibly powerful ones. He’s not a weapon, he’s a shield and a protector.

Can we talk about how Legato’s insane Iron Maiden gun is named Guernica? There’s a lot to unpack there. I’m thinking of Picasso’s painting about the gruesome bombing of Guernica, and honestly? That’s fitting.

Oh, it’s a young Legato? AT JULY? I completely forgot about this flashback.

I see now, it’s not the psychic powers that Legato is using to locate people. It’s his wires. That’s how he finds Knives and probably how he knew Elendira was dead.

Legato was ready to kill Vash in July. He probably would have succeeded if it wasn’t for Conrad and his more pressing concerns about keeping Knives alive. This is another instance of new information making some of Legato’s previous actions make more sense.

His devotion to Knives, but also his early game with Vash, sending assassins after him in revenge for what he did to Knives in July—it’s more than the fact that Vash did it. Legato saw it. He saw the gruesome, bloody remains of Knives’s body and the utter destruction surrounding him. We know how devoted he is and we see how drastically he reacts in the moment. He can’t let Vash get away with so nearly destroying the being he has devoted his life to, no matter what Knives’s wishes might be.

Knives is so terrible. It’s not like this is news, but the audacity. Someone is distraught and crying over you and he tells Legato that he’s being annoying? What an asshole. He spits in the face of all of Legato’s loyalty. Sometimes it really makes you feel bad for Legato even if he’s also terrible in his own ways.

I’m having a hard time parsing these pages, but it looks like Legato dives headfirst into Vash’s defensive forcefield and uses Guernica as a shield. Vash destroys it, but it gives Legato cover so he can get behind him and point a gun at the back of Vash’s head. Okay, let’s go with that. It makes sense.

What did Legato get hit with now? It kinda looks like Vash’s wings?

Ch 9

Legato, honey, you’re so unhinged, it’s unbelievable sometimes. He’s so excited that he’s bleeding out and getting close to death.

Of course, all in the service of Knives. To prove his loyalty because Knives has never readily accepted it before, and that’s really all Legato wants at the end of the day—to see his loyalty rewarded. But since Knives never gave it to him, he just kept escalating and escalating his attempts until we got here. It’s sad that this is what finally brings him joy.

Whether Legato dies or Vash dies, Legato wins. It’s a zero sum game. If Vash dies, Legato proves just how devoted he is to Knives (and then dies because Knives can’t allow humans to live). If Legato dies, he succeeds in breaking Vash’s spirit and his ideals, successfully bringing down Knives’s worst enemy and destroying everything he stands for.

Oh no, it’s Wolfwood’s ghost. He calls us back to one of their earliest arguments over Vash’s no-killing philosophy. One day, Vash will have to make a choice. He’ll be put in a position where to get what he wants, someone will have to die—him or his opponent. What will survive, Vash himself or his philosophy?

It’s telling that in the moments before Wolfwood sealed his fate, he also flashed back to this conversation. Unlike Vash, for most of his life, Wolfwood didn’t have a choice and suddenly, he very clearly had one: save Livio or save himself. He chose Livio, he chose his ideals and sacrificed himself. Someone else mentioned how in dying Wolfwood proved himself wrong: your ideals do survive past your death, they do mean something. Because his death had a ripple effect on the people he loved and it altered the way they acted going forward. His ideals did live on. I don’t know where this is going but I’ve accidentally made myself emotional. Basically, Wolfwood managed to prove himself right and wrong at the same time, and completely alter Vash’s rigid point of view by dying.

Now, Vash is faced with the same choice: kill Legato or save himself so he can defeat Knives. Which road will he choose? What will he decide is more important?

Once again, I do not understand what Legato is doing. He’s got more wires, but who is he attaching them to? Himself? Vash? No idea.

I actually got scared Legato got a shot in, but Vash’s powers protected him again. Looks like Legato wasn’t expecting that either.

Vash is a bridge! He always has been. His whole life, he’s been working to connect humans and Plants, to keep their differences from destroying each other and find a path towards understanding. All in an effort to prove Knives wrong. Humans and Plants could coexist in peace. And he did it with such determination, that he ended up in the memory of every single Plant. That’s wild! It might just be what saves humanity.

Yay, Meryl and Milly get to be part of the effort to communicate with the Plants and help Vash! Vash is so important to them and they’re willing to put themselves in danger to help him, as they’ve proven many times. Because they believe in him and everything he stands for and in that vision of a future where Plants and humans can communicate and coexist in harmony.

“Wow, you two are tough! It’s amazing just how tenacious the people of this planet are!” Vance’s comment about Meryl and Milly is so important. In the story, they’ve represented the regular people of No Man’s Land. They are all the best parts of humanity and they show a hope for a future that isn’t full of blood and gunsmoke.

This entire page makes me wanna cry. It’s just Vash in a nutshell, all his goodness and contradictions and goals wrapped up in one, and it’s so, so beautiful. It just makes you appreciate him all the more and reminds you of how good a person he is (even if Meryl is a little scolding with him).

“I believe in how he chose to live his life.” Meryl’s use of past tense here is…interesting, to say the least.

Oh, Legato is using his wires to keep himself in one piece to survive longer. That makes some of the earlier pages make more sense.

Vash has disappeared behind his glasses again, which never bodes well. I think he’s finally made his choice.

His face when he destroys the coin case says it all honestly. He’s done playing games and he’s done holding back.

I can’t get over how cinematic and evocative these last few pages are. The world literally falling down around them as the Earth fleet ship crashes, the way it separates them for a moment, the way they rush each other and are juxtaposed on the last page. And then, the cliffhanger! With all the debris obscuring Vash and Legato, making us wonder what happened to them. It hits hard and I really badly want to start the next volume already! But then that means it’s the end and that makes me a little sad.
