a forgotten draft - Aug 13, 2022
I’ve stayed up til 3am, reading webcomics, even though I have library duty at 10am. I’ve been binging them pretty hard lately. I stopped keeping up with webnovels after I started getting out of the house. And it’s funny, because some of the comics I’ve read have been adaptations of the same novels I started. Had to drop some, because I didn’t want the comic to ruin the images I had in my head with the novel.
I still can’t stay asleep long, even if I keep going back for naps. So I fill the awake-hours with webcomics. I can’t tell if the stress is from the stick project or if it’s getting-out-of-the-house in general. But I also know that if I want to calm down, I’d need multiple days of not leaving the house - much like my previous pattern.
------------------- For context, this was during my first year of volunteering at the library again. The “Excessive Stick Project” was still new, and the “pause” had not yet happened. Now in 2024, the project has been canceled, though the land annexation is still up-in-the-air.
I’ve become more picky about what webcomics and webnovels I read. I try to give up on anything that gets boring or frustrating asap. Just too many titles out there, quite overwhelming.

Ahh, First and Khaotung. These darlings stole our hearts as Akk and Ayan in GMMTV’s The Eclipse, and continue to enchant us with their wet eyes and legendary bestie status. Unless he had whiskey running through his veins, Willard came to the clearing every morning and evening to talk to God. Arvin didn't know which was worse, the drinking or the praying. As far back as he could remember, it seemed that his father had fought the Devil all the time—
Someone knocks on Jungkook’s door. You look up from your book (The Devil All The Time by Donald Ray Pollock) and smile smugly at Yoongi as he stands in the doorway, a grumpy pout on his face. “Can I help you?” you ask saccharinely.
He grumbles something you don’t catch before saying, “We’re playing Twisters downstairs.”
You gasp dramatically. “Am I dreaming or are you actually being nice to me for once?”
He growls low in his throat. “Don’t push your luck, human.”
You set your book face-down and skip past him, bounding downstairs with a smug grin. “I’m not leaving anytime soon, Boongles, so you better get used to it!”
“What did you just—“
“Y/N!” Jungkook’s face breaks out into a blinding smile as you enter the living room a few paces in front of Yoongi, his metaphorical tail wagging excitedly.
“Hey, Kook. I heard you’re thinking about me,” you tease, gently patting his back when he rolls his eyes and pulls you in for a hug. As you pull away, you ask, “So! How are we doing this?”
“I was thinking teams, since it’s only four of us playing,” Hoseok says, looking up from where he’s slung an arm around a still-grumpy Yoongi’s shoulders. “We can have two players move during one spin, and the other two the next, that way we can take turns so it’s not too chaotic.”
“The others aren’t playing?” you ask, kind of disappointed. Oh, the amount of chaos there would’ve been if more of them had joined you.
Jungkook shakes his head no. “They’re not feeling it. We convinced Jisoo noona to spin for us, though.”
Jisoo walks in from the kitchen with a glass of red wine in hand. She smiles amicably at you as she takes a seat. “Hey, Y/N. How’s the book so far?”
“Good, thanks.” You turn back to the others. “I assume JK and I are gonna be in a team, then?”
Hoseok grins mischievously as he shares a strange look with Jungkook, saying, “Told you. It’s me and you, hyung.” Hoseok smiles down at Yoongi, who sighs his acceptance.
“Let’s get this over with,” he grumbles.
You turn to look at Jungkook, who quickly tries to hide a dopey smile. “Why? What did Hobi oppa tell you?”
“Shh.” He turns you back to the mat with his hands on your shoulders. “Focus on winning.”
“Alright!” Jisoo sets her glass down and picks up the wheel. “First spin!” She flicks the plastic arrow, waiting a few seconds for the outcome before calling out, “Right foot, yellow!”
“You go,” you tell Jungkook. He nods, dropping his hands from your shoulders and taking a confident step forward as Yoongi does the same.
“Next… Right leg, blue!”

In hindsight, Jungkook should’ve seen this coming. He should’ve known Hoseok was trying to set him up from the second he asked if “angel” would be joining them for Twister, even though Jungkook had been more than content to let her stay in his room a little longer. (His complacency with her absence had absolutely nothing to do with the fact that her scent was getting on his sheets.)
Now, with Y/N bending in front of him in a makeshift downward-dog and only one viable option for his next callout (right foot, blue), Jungkook wants to smack his head against a wall. He’d have to move his leg halfway across the mat, so he wouldn’t have any balance.
Unless, of course, he held onto Y/N’s hips.
Twister was a cursed game and he’d never play again.
“Jungkook, you gotta make your move in the next five seconds or else you’re out,” Jisoo warns.
He panics and shifts his foot farther out than he meant to, holding onto Y/N’s hips as his balance gives out and thanking whatever god is out there that Y/N can’t see the disgustingly bright pink hue dusting his cheeks with her ass so close to his crotch.
“You’re gonna make me fall!” Y/N complains, teetering forward. He tightens his grip on her hips and pulls her back ever so slightly. Hopefully he won’t get a boner. Gods, that would be embarrassing.
“Just—focus on your next move!” he half-yells, mouthing a curse at Hoseok, who was knocked out almost five minutes ago and is now standing smugly off to the side trying to contain his laughter. Asshole.
“Stupid game,” Y/N grumbles under her breath, her arms shaking.
“Left hand, red,” Jisoo announces.
Y/N grunts as she moves her hand closer to her body, unintentionally pressing into Jungkook. He bites down on his tongue and focuses on his breathing as blood rushes to his cheeks.
Yoongi huffs as he crouches and sets his hand on the red circle closest to him, grinning up at them with a dark look. “It’s over for you,” he taunts.
“Alright, Kook. Left hand, green,” Jisoo says.
Jungkook crouches down and sets his hand behind him, making eye contact with Y/N for the first time in almost ten minutes straight. “Next time—“
Y/N gets cut off with a yelp as, on their next turn, Yoongi bumps into her and sends her falling back into Jungkook’s lap. He groans, his hands shaking with the effort to keep himself up.
“Asshole! You pushed me!” Y/N yells, her ears turning red with rage as she pushes herself off Jungkook, about to angrily rush Yoongi when Hoseok picks her up around the waist and holds her off to the side with an arm around her shoulders.
“Now-now, kids, no fighting,” he teases.
“Beat his ass, Kook!” Y/N says in response, glaring at Yoongi.
Yoongi rolls his eyes as the game continues. The longer Jungkook has to play, the more tired he becomes—holding weird positions for long periods of time is surprisingly taxing. Just when he thinks he’s going to give out, Yoongi’s sweaty hands slide to the side and he ends up falling over, ass in the air.
Y/N squeals with excitement and rushes Jungkook as he stands up to his full height, massaging his lower back with a grimace. He oofs as she slams into him, her arms around his neck. He blushes and hides his face in her shoulder, trying to subtly breathe in her scent as she drops down before excitedly smacking him on his arm.
He smiles down at her and avoids looking at Hoseok (who he’s sure is having his own little mini-celebration) as Yoongi sighs as he stands up. “Well played,” he grumbles.
Y/N grins triumphantly, but holds her hand out for him to shake. “Good game.” Yoongi hesitates, but takes her hand. Y/N grins. “How does it feel losing to a human?”
“Gods have mercy…”

At long last, a meaningful step to protect Americans' privacy

Privacy raises some thorny, subtle and complex issues. It also raises some stupid-simple ones. The American surveillance industry's shell-game is founded on the deliberate confusion of the two, so that the most modest and sensible actions are posed as reductive, simplistic and unworkable.
Two pillars of the American surveillance industry are credit reporting bureaux and data brokers. Both are unbelievably sleazy, reckless and dangerous, and neither faces any real accountability, let alone regulation.
Remember Equifax, the company that doxed every adult in America and was given a mere wrist-slap, and now continues to assemble nonconsensual dossiers on every one of us, without any material oversight improvements?

It's hard to overstate how fucking scummy the credit reporting world is. Equifax invented the business in 1899, when, as the Retail Credit Company, it used private spies to track queers, political dissidents and "race mixers" so that banks and merchants could discriminate against them:

There are zillions of these data brokers, operating in an unregulated wild west industry. Many of them have been rolled up into tech giants (Oracle owns more than 80 brokers), while others merely do business with ad-tech giants like Google and Meta, who are some of their best customers.
As bad as these two sectors are, they're even worse in combination – the harms data brokers (sloppy, invasive) inflict on us when they supply credit bureaux (consequential, secretive, intransigent) are far worse than the sum of the harms of each.
And now for some good news. The Consumer Finance Protection Bureau, under the leadership of Rohit Chopra, has declared war on this alliance:

As Karl Bode writes for Techdirt, this is long overdue and meaningful. Remember all the handwringing and chest-thumping about Tiktok stealing Americans' data to the Chinese military? China doesn't need Tiktok to get that data – it can buy it from data-brokers. For peanuts.
The CFPB action is part of a muscular style of governance that is characteristic of the best Biden appointees, who are some of the most principled and competent in living memory. And it's true that privacy regulation faces stiff headwinds. Surveillance is a public-private partnership from hell. Cops and spies love to raid the surveillance industries' dossiers, treating them as an off-the-books, warrantless source of unconstitutional personal data on their targets:

These powerful state actors reliably intervene to hamstring attempts at privacy law, defending the massive profits raked in by data brokers and credit bureaux. These profits, meanwhile, can be mobilized as lobbying dollars that work lawmakers and regulators from the private sector side. Caught in the squeeze between powerful government actors (the true "Deep State") and a cartel of filthy rich private spies, lawmakers and regulators are frozen in place.

I don't want to pretend that all privacy questions can be resolved with simple, bright-line rules. It's not clear who "owns" many classes of private data – does your mother own the fact that she gave birth to you, or do you? What if you disagree about such a disclosure – say, if you want to identify your mother as an abusive parent and she objects?
But there are so many stupid-simple privacy questions. Credit bureaux and data-brokers don't inhabit any kind of grey area. They simply should not exist. Getting rid of them is a project of years, but it starts with hacking away at their sources of profits, stripping them of defenses so we can finally annihilate them.

So you have this author.
He has a bunch of projects, sure. Starts his own indie publisher in spring 2017 to start getting them out there. Cool. Good hustle. The problem? One of his projects is the start of a seven-book LOTR fan fiction sequel series.
Fall 2017 - He writes the Tolkien estate asking for rights to publish it. His letters go unanswered. (The Tolkien estate is notoriously litigious and close-fisted with rights.) Undeterred, he keeps plugging along.
April 22, 2019 - He interviews his first beta reader on his indie pub's social media to drum up excitement.
Nov 7, 2019 - He gets a lawyer to ask the Estate for the rights more formally. They say no.
Nov 13, 2019 - The Tolkien estate and Amazon close their $250 mil rights deal on Amazon's upcoming LOTR prequel tv series.
Dec 24, 2019 - Author shows up at Tolkien's grandson's house on christmas eve, and "delivered [his 180k-word manuscript] in-person", including a letter with this line:
"I truly cannot imagine, anyone else alive in the world who is capable of taking the foundation your grandfather wrote and expanding upon it as beautifully and imaginatively as I have." That's a pretty big swing buddy!
Tolkien's grandson mails the manuscript back.
So, he publishes his book anyways.
Sept. 1, 2022 - His book hits the major digital storefronts Sept. 1, 2022. Amazon's LOTR prequel tv series? Also releases Sept. 1, 2022.
He sees some similarities. So what does he do?
April 14, 2023 - He sues the Tolkien estate, the Tolkien trust, Tolkien's grandson, Amazon, and Jeff Bezos himself for $250 million.
June 1, 2023 - The Tolkien trust sues him for copyright infringement right back.
Aug 25, 2023 - Having failed to prove the similarities between the tv show and his book, he loses the first case. (The proposed similarities seem tenuous to me too, but judge for yourself.) He can't sell Tolkien fic ever again. And he has to destroy all the physical copies of his book. And he has to pay their attorney fees. About $134,000.
Dec 14, 2023 - Also failing to prove his work was transformative enough, he loses the second case.
Now, I'm not going to shill for Amazon. US copyright extends 70 years past the death of the creator. That seems to serve corporate interests more than then public imo. If it were up to me, it'd be death + 30 & LOTR would've been public domain in 2003. Author guy could've followed his bliss, and clowning on him now really only serves Amazon's agenda.
But! The lesson here is: while the laws are what they are, if you're going to write fanfiction... literally do anything else but that.
