On Ignorance And its Bane
Prejudice, biases, and discrimination might not be words that everyone is familiar with, but it is a concept or a belief held with judgment at its core. Humanity has never not been judgmental or prejudiced against those they see as other and it is in that unfortunate truth that discrimination still prevails in this day and age. However, in the 21st century, a time of development and innovation without parallel in the course of human history, it must become standard to be intolerant of prejudices, biases, and discrimination, especially not in a world that has never been so connected, global, and intercultural as before.
We live in a world that has so much more potential for free discussion and inclusivity, especially now that we live in a technologically advanced era. There is so much more opportunity to share cultures at the click of a button, and we have the whole world at our fingertips.
One of the main things that bring about prejudice is ignorance. Complete and total ignorance simply leads to us being unaware of another group’s existence, but assumptions and beliefs can form biases that are not necessarily ill-conceived but potentially harmful. Unintentional ignorance is easy to fix on a personal level. It takes teamwork from all parties involved, requiring an open mind, understanding, and accurate information. Intentional ignorance is a whole other thing to deal with. Intentional ignorance could then be called prejudice. Intentional ignorance refuses understanding and closes its mind to unbiased information in favor of further reaffirming established biases. It is difficult to deal with this kind of forceful, intolerant ignorance. The best we can do, then, is prevent unintentional ignorance from morphing into intentional, close-minded prejudice.
Showcasing the cultures of different ethnic or cultural groups can be an effective and highly educational way to inform people of differences in cultures they aren’t familiar with. It encourages discussion and understanding, which is crucial to facilitating an open and friendly conversation that forms judgment not on opinions, but facts. It is so much easier to look past whatever prejudices people have when they remove the veil of ignorance that marks those they misunderstand as others.
I don’t think it’s possible to eliminate all prejudice and biases. Discrimination is an unfortunate fact of life. However, it is possible to minimize it down to the point that it is no longer something normal. It should be something strange and foreign, even, to judge someone based on whatever preconceived notions you might have about them because of an assumption you’ve made or something you’ve heard.
Cultural exchange isn’t the only way to eliminate biases or prejudice, but whatever other method there may be, it works only with open conversation, understanding discussions, and education. People have a strange, innate resistance to being told what to do or think, especially when the notion being pushed onto them is foreign and overwhelming. Creating a safe space for discussion and understanding can encourage people to come to their conclusions, and when given unbiased and truthful information, we can trust that there will be less reason for people to be discriminatory. Prejudice, after all, is a learned concept.
We cannot change the fact that discrimination is very, very real, but it is rooted in misunderstanding, intentional or not. At the end of the day, we cannot force people to be understanding. We can never force other people to think what we want them to think, but what we can do is educate them into forming their own opinions based on truthful and unbiased information through exposure and open conversation.

Romanced companions (fo4) react to a distressed female soul telling them she found out she's turning into a ghoul (she's known it for a while but she's been too afraid to tell them, worrying about how they'd react)
Romanced! FO4 Companions React to F!Sole Turning into a Ghoul
Thank you so much for the ask anon! (and for your patience, I know you sent this one in forever ago 😅)
I always kind of wondered how the companions would react to this if it was a function of the game 🤔 So I'm glad I got to explore it a bit! I hope you enjoy!
Cait:
No. Not her. Not her Sole. Cait thought, unable to grasp the news Sole had just revealed to her. Her partner was too strong, she was too careful. She was from before the bombs, before the radiation! How could this have happened?
In her mind, it would have made a lot more sense for Cait to turn into a ghoul long before Sole. Her arse actually deserved the pain of watching her physical self peel away day by day, but not Sole. Her companion, her partner, the one damn person she actually loved... No, Sole was too good for this. But the two of them, they could beat it, they could reverse it somehow. One of those vaults could hold the answer, like it did for her, even after she had thought it was too late.
Cait didn't want to stop the change because she had anything against ghouls, really, because she doesn't. But she couldn't stand the sight of her luv's face when, at the light brush of her fingers through her once silky locks, she felt them fall to the ground in webbed clumps, Cait couldn't stand the pain in Sole's expression as her skin began to shrivel and peel off, she couldn’t witness one more instance of Sole glancing in a mirror with such immense sadness in her eyes. And Cait became very troubled when she realized that Sole would be here long after she was dead. Cait couldn't stand to face reality without her partner after all that she's done for her, and now Sole was staring that reality in the face. The poor lass had already outlived everyone she's known and loved once, and now she had to do it all over again, who knows how many times? It just wasn't fuckin' fair.
Well, once Cait had accepted Sole's change as permanent, she would do everything in her power to ensure the pair made the most of their years together, giving absolutely no fucks about Sole's new appearance. And should anyone else decide to look at her the wrong way, or, God forbid, say something to her about it, Cait's fist would be unholstered and swinging before the offensive words could even leave their worthless lips.
Curie:
She would feel sorry for Sole, and constantly be there for her as a source of support. When her love had told her what was happening, Curie had been shocked. Sure, she had noticed a few changes in her partner’s body, but she had hoped it wouldn’t be anything too serious. Still, this wasn't the worst that could happen, Curie would know, after all of the diseases and viruses she had worked with in the vault. Yet... the synth still found her chest throbbing at the thought of watching her love deteriorate before her eyes.
Throughout Sole’s change, Curie would do what she could to lessen the symptoms. There was no “cure” for being a ghoul, but Curie would feel awful if she didn’t at least try.
As Sole’s condition became more and more obvious, she would do everything in her power to make sure her partner knew that she still loved her. Curie had been a reprogrammed Miss Nanny when Sole had found her, she'd been nothing more than a metal machine when Sole had selflessly saved her, and yet, she had found a way to love her for who she was, despite what she was, and she had been there every step of the way as she made the change to her synth body. Curie would be happy to return the favor tenfold.
Also, throughout the process of Sole's change, if anyone was rude to her love, about anything, Curie would be at them with harsh words and a firm teacher’s voice as she gave the ill-mannered stranger a quick ghouls-101 education session.
Danse (Post BB):
Oh… Oh God. Not this. Not her, not his beautiful Sole. The ex-paladin’s stomach would drop as she quietly forced out her confession, refusing to meet his wide, despairing gaze.
He didn’t know what to do. Danse was horrified. Not for the first time in his life, he felt like his world was crashing down all around him. Everything good in his life seemed to revolve around the person in front of him, but all of his love, his devotion, all of the effort he put into protecting this one person he had left, that he valued above all else in his life, it was all in vain. Because now… she was turning into something that he had always feared. Something that he had been taught and trained to despise, to think of as vermin that needed to be extinguished. It was the way he felt about himself when he found out what he truly was. He never wanted to feel that way towards her, never thought he would have been able to, and even now… he found that he couldn’t.
It didn’t matter what she was turning into, what she’d become, she was still Sole. And he was committed to her, he was loyal to her. Godammit, he loved her for Christ's sake. He wasn’t about to let this calamitous development change any of that. She certainly hadn’t when it had been him in her place.
Danse would still often have trouble with his internalized prejudices left over from his time with the Brotherhood, but he would try his heart out for her. Every passing day brought more changes to the woman he loved, each one serving as a reminder to what the end result would be, and witnessing it would break his heart into pieces.
It was strange though, it wasn’t as devastating as he had thought it would be, in the beginning. Sole was still herself, even underneath all of the physical changes, she was still here beside him, and in the end, that’s all Danse really needed.
Deacon:
For once, Deacon remained silent. His brows furrowed low beneath his sunglasses and his hand came up to rub at his mouth, as though he were trying to physically pull out a response. He cleared his throat, and his hand went up to remove his glasses so he could look Sole in the eye. A rare sight, one that made her pulse quicken further as the apprehension of her confession really set in.
Deacon had already known, or… suspected, rather, but he hadn’t wanted to believe it. It wouldn’t be the first time the Railroad agent's experienced this kind of dread. When he had found out his wife was a synth, he had felt this same crippling pressure in his chest. But he didn’t say that, Sole didn’t need to hear about his problems, no, not again. Now she needed him to help with hers.
So, the spy would nod at her, and ask her what she needed from him. He's a knowledgeable guy, everyone knows that, Sole most of all, so if she needed anything as far as information on what she was about to go through, he would be able to provide it. Better yet, he could bring her to quite a few folks he knew who had gone through the same sorta hell themselves.
Beyond that, not much else would change. Deacon isn't one to put much stock in a person's physicality, what kinda daft and inconsiderate hypocrite would he be if he did? Hell, he may even speak to a surgeon about altering his appearance to become more ghoul-like if that was something Sole cared about. But honestly? He just would want his partner to know that it didn't matter to him.
"Thought you could get rid of lil old me just by going ghoul? Heh, sorry, cuddle muffin, but it looks like you're still stuck with me."
Sole had been able to forgive him for everything he's done, she hadn't judged or ridiculed him for being a bigoted assface for the first half of his life, and she'd accepted him for the compulsive liar and emotion-dodging, sarcastic smart-ass that he was now; sooooooo, yeah. This whole ghoul thing? Not a problem. Just another glorious and compelling chapter in this wacky book called life.
Hancock:
Hancock becomes the literal epitome of empathy. He knows what this shit's like, he's gone through the motions. He remembers the nightmarish sight of his flesh falling from his body in shriveled tatters, he recalls his once silken voice dissolving to his current raspy timbre, he knows what it's like to see the bright vibrance of his irises vanish over the course of a couple weeks, slowly dissolving to the blackness that he now saw the world through.
But with Hancock, it had been his choice. Okay, so he didn't know for certain that he'd become a ghoul, but he had been ready for it, had known it was at least a possibility. With Sole though, she didn't sign up for this shit. She didn't deserve to go through the same kinda hell he did. He wanted to go through hell, felt like he deserved it. But his gorgeous sunshine? The light of his life, the kindest, most selfless person he'd ever met? Nah. She didn't deserve to watch herself develop the likeness of a certain sorta dehydrated fruit.
Hancock would be sure to tell her every day just how incredible she was, how brave, and strong, and how she was still beautiful beyond belief, no matter what. He would show her how he felt. Showering her in gifts and affection, taking her out to prove to her that he could never even think to be embarrassed by her in any capacity whatsoever. He loved this woman, he cherished her. Every irradiated bit of her.
And now… now the best part. Hancock would try not to seem too overexcited, knowing that this whole process was traumatic and painful for his love, but now he could spend the rest of their lives making her see just how much one person-- one ghoul-- could love another. He'd been terrified out of his mind when he thought he would outlive Sole, by who knows how long. But now… now they had an eternity to spend together, or, however long it is ghouls live for. Whatever, no matter how much time they had, Hancock would never be convinced it would be enough. He just supposes the rest of their long lives will simply have to do.
MacCready:
He'd try not to give away his heartbreak as he gazed back at her, his face draining of all it's color as those fateful words escaped her with a sob. This was a nightmare of MacCready's. He hadn't ever told Sole what he saw that night he had woken up screaming, he had told her he couldn't remember the dream, and she had said "maybe that was for the best." If only he'd been telling the truth. In reality, what he saw was the immensely frightening sight of Sole taking his late wife's place in that horrific memory that was forever burned into his brain. Her body engulfed by a throng of writhing ferals as she shrieked out his name. As with all of his dreams like this, MacCready was rooted to the place he stood, forever imprisoned as a bystander to the brutality taking place before him. The agony only ceased when the pack of feral ghouls dispersed, revealing Sole, now as one of them. She had raced towards him, hunger and madness glinting in the opaque depths of her dark, iris-less eyes. The mercenary couldn't get the image out of his head as he watched the color in Sole's eyes fade away over time, her skin losing its divine smoothness, her soft hair drifting to the ground in wisps of somber defeat.
The couple had cried a lot in those weeks of her change. The process was heart wrenching for the both of them to witness; but MacCready stuck by her side. He could be stronger than his nightmares, than his fears, when it came to Sole.
When the day finally did come when she was referred to as a ghoul by a perfect stranger, MacCready had almost been surprised. It had taken time for her to look this way, to sound this way, and he had hardly noticed the extent to which his partner changed until looking at old renderings and pictures of her from before the bombs. This was just who she was now.
She wasn't a monster, a ravenous zombie that he feared and despised. She was Sole. She still acted like his love, her voice still resembled that of his partner's, her eyes had lightened to a blue that outshone his own, which he was clearly not bitter about, and she still was just utterly his Sole. The same woman he had fallen for in the first place, the one he thought he'd never be lucky enough to be loved by in return. But now, even behind all the changes, he could still see her there, and he could certainly still love her.
The nightmares became much less common after her transformation, oddly enough. And when he finally introduced Sole to Duncan, he was terribly worried that the boy would hate her, that he would remember that traumatic night when the pair had lost a mother and a wife, and that he would be afraid of her. But his son hardly seemed to notice Sole's condition, as he shook her hand and introduced himself with enthusiastic giddiness. Later, Duncan might voice some questions to her about being a ghoul, but they were always out of genuine curiosity.
MacCready couldn't have been more proud of his child than he was then, or more touched than when Duncan expressed his relief at Sole having a skin condition like this, and yet, she was still able to be loved by someone as great as his dad. The boy himself remembered the way people would look at him before he had been cured of his blue boils, and he didn't wish that on anybody, he'd assured both Sole and MacCready of that one day.
No, MacCready couldn't have been more proud. Of his son, sometimes even of himself as he learned to outgrow his fears, how to muscle through his trauma and be the best father and partner he could possibly be; and certainly, he couldn't have been prouder of Sole.
Nick:
Nick would be remarkably sympathetic, taking Sole's hand in his good one comfortingly as she struggled to get out the confession, and having not even a glimpse of a negative reaction in response to her heart-wrenching words.
“Oh, doll… I’m so sorry.” His fingers would stroke over her hand in an effort to comfort her. He had been surprised by the news, but it wouldn’t change anything. He’d assure her of that. No matter what physical changes Sole underwent; the memories of a certain synth, all metal, and fiberglass, and plastic, and the damn near perfect woman who somehow fell for him would fill his mind, and he wouldn’t be able to keep from telling her just how much she meant to him every single day.
Life would go on, they would go out on cases together, and help the people of the commonwealth as they have nearly since the day they met, but if anyone decided to utter a comment as to Sole’s physical state, they would certainly be faced with a stern talking to from one sassy synth.
He tried to not mention it too early on, but Nick wouldn't be unable to keep the thought buried forever. One day, when Sole was feeling especially despondent about her current state, he’d remind her that he’d always be there for her. Always. Now he didn’t have to worry so much about that dreadful and inevitable fast-approaching day that he would have to bid Sole goodbye as she passed away from her old age, leaving him alone on this ruined earth. He’d just have to hope that she would be as comforted by the thought as he was.
Piper:
The news would be hard to grasp at first, and even after she understood what Sole was telling her, she wouldn't know what to do. How can you fix something like this? This was her Blue they were talking about! She could do anything, she'd survived the bombs, had found the Institute, she had found her son after so many years, had done all of that, just to now have to go through this too? Hasn't Sole been through enough?!
Piper would be angry, and she'd feel horrible watching Sole go through the changes, as she was forced to witness her love's physical form deteriorate before her in just a couple short months. Piper would try to tell Sole to keep her chin up, remind her who she was, of everything she's been through, how much she's overcome; and if anyone wanted to bug her partner about being a ghoul, Piper would tear them to shreds with her words, not caring if she made a scene as she made the stranger realize what horrible mistake they had made speaking to Sole like that. She'd rip ‘em a new one for sure, and spend a good portion of the day making sure her love was alright after the ordeal. The reporter knew how much words could hurt.
She would be utterly supportive, and even, if Sole was comfortable with it, might see if she’s interested in being a sort of poster child for a campaign to allow ghouls back into Diamond City (and God help anyone who tries to keep Sole out of the city before Piper has a chance to change the law officially.)
Preston:
Preston tried to swallow through the lump in his throat, but to no avail. The Minuteman didn’t cry often, or, he hadn’t since meeting Sole. But this… He couldn’t stop the tears from spilling as he drew her into his embrace. His voice surely would have failed him if he had tried to comfort her with his words, so his arms wrapped tightly around her, her head pressed firmly to his chest. That would have to do for the time being.
“Sole, I can’t tell you how sorry I am.” He managed to whisper to her as his hand came up to stroke gently at her soft hair, trying desperately not to imagine the way it would fall from her head soon enough. He took a deep breath.
“But… I want you to know something. Something really important.” Preston pulled away so he could look into her eyes, hands coming to rest on either of her tear-stained cheeks “This won’t change anything between us. No matter what, you’re still my General, and… and I love you so much. What’s happening to you won’t ever change the way I feel about you.” They’d both be sniveling messes through the night.
But each morning that passed in the coming days, each change Sole underwent, they would take as it came. Preston is a bit of a workaholic, he knows this, and so does Sole, but he’d take a day off if ever her symptoms became unbearable enough. The Minutemen were stronger now than they had been in years, because of her, and so he would try not to feel so guilty about stepping away from his duties to help her.
But he would keep his promise, and, through everything, Sole would remain the General of the Minutemen, with everyone still paying her the respect that the title was due. She would remain the love of his life, he would tell her every day the way that he admired her, tell her how gorgeous he found her, no matter how much her physicality changed, he would remind her of her boundless strength. He just hoped it’d be enough to make her happy, to save her back, in the way she had saved him.
X6-88:
When Sole hesitantly told him about what was happening to her, it had only been after he asked. It was clear to the synth that something was wrong with his partner, but waiting for her to explain on her own had him only becoming more impatient. When she did tell him, he was furious. Certainly not at her, and not necessarily at the Institute’s inability to prevent it from happening, but at the Commonwealth, at the world for doing this to the one he loved. X6 couldn't stand the thought of it, the pain she had to go through. A part of him blamed himself for it. He was meant to protect her, from anything that could possibly harm her, and he had failed. Her changing appearance would be a testament to that failure every day of his life.
In an effort to make it up to her, X6 offered everything he possibly could to his partner, walking her though each and every symptom that came with her change, and ensuring she was utilizing every resource the Institute had at its disposal. Treatments, and skin creams, and supplements, and enough radaway to douse the glowing sea were used in an effort to slow the process of ghoulification, or perhaps even to halt it.
When it inevitably didn’t work, X6 would feel useless, like he had failed in his mission to keep his beloved safe all over again. However, something strange happened to the courser when the one he loves began to physically fall apart in response to the radiation. He didn’t want to leave her. He could stand to look at her, to still love her in the way that he never thought he would be able to, even when she was human. Despite what she had become, she was still his Sole.
After he came to this realization, X6 would take it as a personal mission for himself to ensure that anyone who made Sole feel bad for the way she looked or the way she now spoke would pay dearly for the carelessness of their commentary. X6 would work endlessly to guard his love from insults and dangers alike, from outsiders as well as those within the Institute. That was what he could do for her, what he had to do, if he ever wanted to make it up to Sole. The way he had carelessly let this happen to her... He would never forgive himself, and wonder every day how Sole could, but he will make it up to her. Mark his words.

the many faces of tom riddle, part 4
-attachment, orphanages, and yet more child psych: time to add yet another voice to the void-
FULL DISCLAIMER THAT THIS IS JUST MY OPINION OF A CHARACTER WHO DOESN’T HAVE THE STRONGEST CANON CHARACTERIZATION, AND THUS ALL THIS IS BASED ON MY CONCEPTUALIZATION.
Tumblr media
I'm going to be super biased, because my favorite portrayal of Tom Riddle is actually Hero Fiennes-Tiffin as eleven-year-old Tom Riddle, in HBP and I get to chat about child psych in this one, sooo here we go.
First of all, I’m just so impressed that a kid could bring that much depth to such a complex character.
This is the portrayal, I feel, that brings us closest to Tom’s character. Yes, Coulson’s brought us pretty close, but by fifth year, the mask was on.
We don't really get to see Tom looking afraid very often, but it's fear that rules his life, so it's really poignant in our first (chronologically) introduction, he looks absolutely terrified.
The void being the fandom's loud opinions on a certain headmaster. I wouldn't call myself pro-Dumbledore, but I'm certainly not anti-Dumbledore, either. (Agnostic-Dumbledore??)
Since I'm not of the anti-Dumbledore persuasion, I decided to poke around in the tags and see what the arguments were, so I don't make comments out of ignorance.
Most of the tag seems to be more directed towards his treatment of Harry and Sirius, but a few people mentioned that Dumbledore should have treated Tom with ‘exceptional kindness’ and tried to ‘rehabilitate’ him.
As I said in Parts 2 and 3, I am 100% in favor of helping a traumatized kid learn to cope, and I don’t think Tom Riddle was solidly on the Path to Evil (TM) at birth, or even at eleven. Not even at fifteen.
Could unconditional love and kindness have helped Tom Riddle enough for the rise of Lord Voldemort to never happen? Possibly, but...
Yes, I'm about to drag up that Carl Jung quote, again.
“I am not what happened to me, I am what I choose to become.”
The problem with this is that if you’re going to blame Dumbledore for this, you also have to blame every other adult in Tom’s life: his headmaster, Dippet, his Head of House, Slughorn, his ‘caretakers’ at the orphanage, Mrs. Cole and Martha, and possibly more. In fact, if we're going to blame any adult, let's blame Merope for r*ping and abusing Tom Riddle Senior, and having a kid she wasn't intending to take care of.
Furthermore, you cannot possibly hold anyone but Tom accountable for the murders he committed. (I should not have to sit here and explain why cold-blooded murder is wrong.) And if you like Tom Riddle's character, insinuating that his actions are completely at the whim of others is just a bit condescending towards him. He's not an automaton or a marionette, he's a very intelligent human being with a functioning brain, and at sixteen is fully capable of moral reasoning and critical analysis.
I've heard the theories about Dumbledore setting the Potters up to die, and I'm not going to discuss their validity right now; but he didn't put a wand in Tom's hand and force him to kill anyone. Tom did it all of his own accord.
And while yes, I have enormous sympathy for what happened to Tom as a child, at some point, he decided to murder Myrtle Warren, and that is where I lose my sympathy. Experiencing trauma does not give you the right to inflict harm on others. Yes, Tom was failed, but then, he spectacularly failed himself.
We also have no idea how Dumbledore treated Tom as a student.
In the movies, it’s Dumbledore who tells Tom he has to go back to the orphanage, but in the books, it’s Dippet. We know that Slughorn spent a lot of time around Tom at Slug Club and such, yet I don’t really see people clamoring for his head.
I regard the sentiment that Dumbledore turned Tom Riddle into Lord Voldemort with a lot of skepticism.
But let's hear from the character himself -- his impression of eleven-year-old Tom Riddle.
Tumblr media
“Did I know that I had just met the most dangerous Dark wizard of all time?” said Dumbledore. “No, I had no idea that he was to grow up to be what he is. However, I was certainly intrigued by him. I returned to Hogwarts intending to keep an eye upon him, something I should have done in any case, given that he was alone and friendless, but which, already, I felt I ought to do for others’ sake as much as his."
Now, assuming that Dumbledore's telling the truth, I'm not seeing something glaringly wrong with this. No, he hasn't pigeonholed Tom as evil, yes, I'd be intrigued, too, and it's a very good idea to keep an eye on Tom, for his own sake.
“At Hogwarts,” Dumbledore went on, “we teach you not only to use magic, but to control it. You have — inadvertently, I am sure — been using your powers in a way that is neither taught nor tolerated at our school."
Again, it seems like he's at least somewhat sympathetic towards Tom, and is willing to at least give him a chance.
More evidence (again, assuming Dumbledore is a reliable narrator):
Harry: “Didn’t you tell them [the other professors], sir, what he’d been like when you met him at the orphanage?” Dumbledore: “No, I did not. Though he had shown no hint of remorse, it was possible that he felt sorry for how he had behaved before and was resolved to turn over a fresh leaf. I chose to give him that chance.”
Now, I think Dumbledore is pretty awful with kids, but I don't think that's malicious. Yeah, it's a flaw, but perfect people don't exist, and perfect characters are dead boring. I am not saying that he definitely handled Tom's case well, I'm just saying that there's little evidence that Dumbledore, however shaken and scandalized, wrote him off as 'evil snake boy.'
It's also worth taking into account that it's 1938, and the attitudes towards mental health back then.
Why is Tom looking at Dumbledore like that, anyway? Why is he so scared? What has he possibly been threatened with or heard whispers of?
"'Professor'?" repeated Riddle. He looked wary. "Is that like 'doctor'? What are you here for? Did she get you in to have a look at me?"
"I don't believe you," said Riddle. "She wants me looked at, doesn't she? Tell the truth!"
"You can't kid me! The asylum, that's where you're from, isn't it? 'Professor,' yes, of course -- well, I'm not going, see? That old cat's the one who should be in the asylum. I never did anything to little Amy Benson or Dennis Bishop, and you can ask them, they'll tell you!
Tom keeps insisting he's not mad until Dumbledore finally manages to calm him down.
Tumblr media
I'm really upset this wasn't in the movie, because it's important context. Instead we got these throwaway cutscenes of some knick-knacks relating to the Cave he's got lying around, but I just would have preferred to see him freaking out like he does in the book.
There was extreme stigma and prejudice towards mental illness.
'Lunatic asylums,' as they were called in Tom's time, were terrible places. In the 1930s and 40s, he could look forward to being 'treated' with induced convulsions, via metrazol, insulin, electroshock, and malaria injections. And if he stuck around long enough, he could even look forward to a lobotomy!
So, if you think Dumbledore was judgmental towards Tom, imagine how flat-out prejudiced whatever doctors or 'experts' Mrs. Cole might have gotten in to 'look at him' must have been!
Tumblr media
Moving on to the next few shots, he is sitting down and hunched over as if expecting punishment or at least some kind of bad news, Dumbledore is mostly out of the frame. He’s trapped visually, by Dumbledore on one side, and a wall on the other, because he’s still very much afraid. uncomfortable, as he tells Dumbledore a secret that he fears could get him committed to an asylum (which were fucking horrible places, as I said).
It brings to the scene that miserable sense of isolation and loneliness to that has defined Tom’s entire life up to that point (and, partially due to his own bad choices, continues to define it).
And, when Dumbledore accepts it, his posture changes. he becomes more confident and more at ease, as he describes the... utilities of his magical abilities.
"All sorts," breathed Riddle. A flush of excitement was rising up his neck into his hollow cheeks; he looked fevered. "I can make things move without touching them. I can make animals do what I want them to do, without training them. I can make bad things happen to people who annoy me. I can make them hurt if I want to."
Riddle lifted his head. His face was transfigured: There was a wild happiness upon it, yet for some reason it did not make him better looking; on the contrary, his finely carved features seemed somehow rougher, his expression almost bestial.
I do think Harry, our narrator, is being a tad bit judgmental here. Magic is probably the only thing that brings Tom happiness in his grey, lonely world, and when I was Tom's age and being bullied, if I had magic powers, you'd better believe that I'd (a) be bloody ecstatic about it (b) use them. And, like Tom, I can't honestly say that I can't imagine getting a bit carried-away with it. Unfortunately, we can't all be as inherently good and kindhearted as Harry.
Reading HBP again, as a 'mature' person, it almost seems like the reader is being prompted to see Tom as evil just because he's got 'weird' facial expressions.
So... uh...
Nope, let's judge Tom on his actions, not looks of 'wild happiness.'
Tumblr media
To his great surprise, however, Dumbledore drew his wand from an inside pocket of his suit jacket, pointed it at the shabby wardrobe in the corner, and gave the wand a casual flick. The wardrobe burst into flames. Riddle jumped to his feet; Harry could hardly blame him for howling in shock and rage; all his worldly possessions must be in there. But even as Riddle rounded on Dumbledore, the flames vanished, leaving the wardrobe completely undamaged.
Okay, one thing I dislike is Tom's lack of emotional affect when Dumbledore burned the wardrobe, in the books, he jumped up and started screaming, instead of looking passively (in shock, perhaps?) at the fire. Incidentally, I can't really tell if he's impressed or in shock, to be honest. I think they really tried to make Tom 'creepier' in the movie.
This is one of the incidents where Dumbledore's inability to deal with children crops up.
I think he was trying to teach Tom that magic can be dangerous, and he wouldn't like it to be used against him, but burning the wardrobe that contains everything he owns was a terrible move on Dumbledore's part. Tom already has very limited trust in other people, and now, he's not going to trust Dumbledore at all -- now, he's put Tom on the defensive/offensive for the rest of their interaction, and perhaps for the rest of their teacher-student relationship.
Riddle stared from the wardrobe to Dumbledore; then, his expression greedy, he pointed at the wand. "Where can I get one of them?"
"Where do you buy spellbooks?" interrupted Riddle, who had taken the heavy money bag without thanking Dumbledore, and was now examining a fat gold Galleon.
But I'm not surprised Tom is 'greedy.' He's grown up in an environment where if he wants something, whether that's affection, food, money, toys, he's got to take it. There's no one looking after his needs specifically. I'm not surprised that he's a thief and a hoarder, and I don't think that counts as a moral failing necessarily, and more of a maladaptive way of seeking comfort. It would be bizarre if he came out of Wool's Orphanage a complete saint.
Additionally, I think given that the Gaunt family has a history of 'mental instability,' Tom is a sensitive child, and the trauma of growing up institutionalized and possibly being treated badly due to his magical abilities or personality disorder deeply affected him.
And there are points where it seems that Dumbledore is quick to judge Tom.
Tumblr media
"He was already using magic against other people, to frighten, to punish, to control."
"Yes, indeed; a rare ability, and one supposedly connected with the Dark Arts, although as we know, there are Parselmouths among the great and the good too. In fact, his ability to speak to serpents did not make me nearly as uneasy as his obvious instincts for cruelty, secrecy, and domination."
"I trust that you also noticed that Tom Riddle was already highly self-sufficient, secretive, and, apparently, friendless?..."
And while this is all empirically true, these are (a) a product of Tom's harsh environment, and (b) do not necessarily make him evil. But the point remains that child psych didn't exist as a field of its own, and psychology as a proper science was in its infancy, so I'd be shocked if Dumbledore was insightful about Tom's situation.
But I've gone a ton of paragraphs without citing anything, so I've got to rectify that.
Let's talk about Harry Harlow's monkey experiments in the 1950-70s.
If you're not a fan of animal research, since I know some people are uncomfortable with it, feel free to scroll past.
Here's the TL;DR: Children need to be hugged and shown affection too, not just fed and clothed, please don't leave babies to 'cry out' and ignore their needs because it's backwards and fucking inhumane. HUG AND COMFORT AND CODDLE CHILDREN AND SPOIL THEM WITH AFFECTION!
I will put more red writing when the section is over.
This is still an interesting experiment to have in mind while we explore the whole 'no one taught Tom Riddle how to love' thing and whether or not it's actually a good argument.
Andddd let's go all the way back to the initial 1958 experiment, featured in Harlow's paper, the Nature of Love. (If you're familiar with Maslow's Hierarchy of Needs, him and Harlow actually collaborated for a time).
To give you an idea of our starting point, until Harlow's experiment, which happened twenty years after Dumbledore meets Tom for the first time, no one in science had really been interested in studying love and affection.
"Psychologists, at least psychologists who write textbooks, not only show no interest in the origin and development of love or affection, but they seem to be unaware of its very existence."
I'm going to link some videos of Harry Harlow showing the actual experiment, which animal rights activists would probably consider 'horrifying.' It's nothing gory or anything, but if you are particularly soft-hearted (and I do not mean that as an insult), be warned. It's mostly just baby monkeys being very upset and Harlow discussing it in a callous manner. Yes, today it would be considered unethical, but it's still incredibly important work and if you think you can handle it, I would recommend watching at least the first one to get an idea of how dramatic this effect is.
Dependency when frightened
The full experiment
The TL;DW:
This experiment was conducted with rhesus macaques; they're still used in psychology/neuroscience research when you want very human-like subjects, because they are very intelligent (unnervingly so, actually). I'd say that adult ones remind me of a three-year old child.
Harlow separated newborn monkeys from their mothers, and cared for their physical needs. They had ample nutrition, bedding, warmth, et cetera. However, the researchers noticed that the monkeys:
(a) were absolutely miserable. And not just that, but although all their physical needs were taken care of, they weren't surviving well past the first few days of life. (This has also been documented in human babies, and it's called failure to thrive and I'll talk about it a bit later).
(b) showed a strong attachment to the gauze pads used to cover the floor, and decided to investigate.
So, they decided to provide a surrogate 'mother.' Two, actually. Mother #1 was basically a heated fuzzy doll that was nice for the monkeys to cuddle with. Mother #2 was the same, but not fuzzy and made of wire. Both provided milk. The result? The monkeys spent all their time cuddling and feeding from the fuzzy 'mother.' Perhaps not surprising.
What Harlow decided next, is that one of the hallmarks being attached to your caregiver is seeking hugs and reassurance from them when frightened. So, when the monkeys were presented with something scary, they'd go straight to the cloth mother and ignore the wire one. Not only that, but when placed in an unfamiliar environment, if the cloth mother was present, the monkeys would be much calmer.
In a follow-up experiment, Harlow decided to see if there was some sort of sensitive period by introducing both 'mothers' to monkeys who had been raised in isolation for 250 days. Guess what?
The initial reaction of the monkeys to the alterations was one of extreme disturbance. All the infants screamed violently and made repeated attempts to escape the cage whenever the door was opened. They kept a maximum distance from the mother surrogates and exhibited a considerable amount of rocking and crouching behavior, indicative of emotionality.
Yikes. So, at first Harlow thought that they'd passed some kind of sensitive period for socialization. But after a day or two they calmed down and started chilling out with the cloth mother like the other monkeys did. But here's a weird thing:
That the control monkeys develop affection or love for the cloth mother when she is introduced into the cage at 250 days of age cannot be questioned. There is every reason to believe, however, that this interval of delay depresses the intensity of the affectional response below that of the infant monkeys that were surrogate-mothered from birth onward
All these things... attachment, affection, love, seeking comfort ... are mostly learned behaviours.
Over.
Orphanages, institutionalized childcare, and why affection is a need, not an extra.
Tumblr media
His face is lit the exact same was as Coulson’s was in COS (half-light, half-dark), and I said I was going to talk about this in Part 3. I think perhaps it's intended to make Fiennes-Tiffin look more evil or menacing, but I'm going to quite deliberately misinterpret it.
Now, for some context, Dumbledore has just (kind of) burned his wardrobe, ratted out his stealing habit, and (in the books only, they really took a pair of scissors to this scene) told him he needs to go apologize and return everything and Dumbledore will know if he doesn't, and, well, Tom's not exactly a happy bugger about it.
But interestingly, in the books, this is when we start to see Tom's 'persona,' aka his mask, start to come into play. Whereas before, he was screaming, howling, and generally freaking out, here, he starts to hide his emotions -- in essence, obscure his true self under a shadow. So this scene is really the reverse of Coulson's in COS.
And perhaps I'm reading wayyy too much into this, but I can't help but notice that Coulson's hair is parted opposite to Fiennes-Tiffin's, and the opposite sides of their faces are shadowed, too.
Riddle threw Dumbledore a long, clear, calculating look. "Yes, I suppose so, sir," he said finally, in an expressionless voice.
Riddle did not look remotely abashed; he was still staring coldly and appraisingly at Dumbledore. At last he said in a colorless voice, "Yes, sir."
Here's an article from The Atlantic on Romanian orphanages in the 1980s, when the dictator, Ceausescu, basically forced people to have as many children as possible and funnel them into institutionalized 'childcare', and it's absolutely heartbreaking.
There's not a whole lot of information out there on British orphanages in the 30s' and 40s', but given that people back then thought you just had to keep children on a strict schedule and feed them, it wouldn't have a whole lot better.
The only thing I've found is this, and it's not super promising.
The most important study informing the criteria for contemporary nosologies, was a study by Barbara Tizard and her colleagues of young children being raised in residential nurseries in London (Tizard, 1977). These nurseries had lower child to caregiver ratios than many previous studies of institutionalized children. Also, the children were raised in mixed aged groups and had adequate books and toys available. Nevertheless, caregivers were explicitly discouraged from forming attachments to the children in their care.
Here's a fairly recent paper that I think gives a good summary: Link
Here, they describe the responses to the Strange Situation test (which tests a child's attachment to their caregiver).
We found that 100% of the community sample received a score of “5,” indicating fully formed attachments, whereas only 3% of the infants living in institutions demonstrated fully formed attachments. The remaining 97% showed absent, incomplete, or odd and abnormal attachment behaviors.
Bowlby and Ainsworth, who did the initial study, thought that children would always attach to their caregivers, regardless of neglect or abuse. But some infants don't attach (discussed along with RAD in Part 2).
Here's a really good review paper on attachment disorders in currently or formerly institutionalized children : Link
Core features of RAD in young children include the absence of focused attachment behaviors directed towards a preferred caregiver, failure to seek and respond to comforting when distressed, reduced social and emotional reciprocity, and disturbances of emotion regulation, including reduced positive affect and unexplained fearfulness or irritability.
Which all sounds a lot like Tom in this scene. The paper also discusses neurological effects, like atypical EEG power distribution (aka brain waves), which can correlate with 'indiscriminate' behavior and poor inhibitory control; which makes sense for a kid who, oh, I don't know, hung another kid's rabbit because they were angry.
Furthermore...
...those children with more prolonged institutional rearing showed reduced amygdala discrimination and more indiscriminate behavior.
This again, makes a ton of sense for Tom's psychological profile, because the amygdala (which is part of the limbic system, which regulates emotions) plays a major role in fear, anger, anxiety, and aggression, especially with respect to learning, motivation and memory.
So, I agree completely that Tom needed a lot of help, especially given the fact that he spent eleven years in an orphanage (longer than the Bucharest study I was referring to), and Dumbledore wasn't exactly understanding of his situation, and probably didn't realise what a dramatic effect the orphanage had on Tom, and given the way he talks to Tom, probably treated him as if he were a kid who grew up in a healthy environment.
In case you are still unconvinced that hugging is that important, there's a famous 1944 study conducted on 40 newborn human infants to see what would happen if their physical needs (fed, bathed, diapers changed) were provided for with no affection. The study had to be stopped because half the babies died after four months. Affection leads to the production of hormones and boosts the immune system, which increases survival, and that is why we hug children and babies should not be in orphanages. They are supposed to be hugged, all the time. I can't find the citation right now, I'll add it later if I find it.
But I think it's vastly unrealistic to say that Dumbledore, who grew up during the Victorian Era, would have any grasp of this and I don't think he was actively malicious towards Tom.
Was Tom Riddle failed by institutional childcare? Absolutely.
Were the adults in his life oblivious to his situation? Probably.
Do the shitty things that happened to Tom excuse the murders he committed, and are they anyone's fault but his own? No. At the end of the day, Tom made all the wrong choices.
And, for what it's worth, I think (film) Dumbledore (although he expresses the same sentiment in more words in the books) wishes he could go back in time and have helped Tom.
"Draco. Years ago, I knew a boy, who made all the wrong choices. Please, let me help you."

Giant-Size X-Men Abridged: 1975
The X-Men, those all-new, all-different mutants that have sworn to protect a world that hates and fears them, are a cultural juggernaut with a long, tangled history. Want to unravel this tapestry? Then read the Abridged X-Men!
(Giant-Size X-Men #1) - by Len Wein and Dave Cockrum.
Tumblr media
“Okay, Dave, we want the new guys to look infinitely cooler than the old guys. Especially Beast. Fuck Beast.”
“Say no more.”
If you were Charles Xavier and you accidentally misplaced your team of misfit mutants (except for Beast, who has graduated to Avengerdom and isn’t even in this book), would you:
Call in a favor with the Avengers or the Fantastic Four to help you out?
Call your ex and ask him and his magnetic powers to come to your rescue?
Cut your losses and move on?
Travel the world to replace your boring wonderbread team with a bunch of spicier, kickassier mutants and forever rock the world?
The answer is obviously D. I am hyperventilating. At the end of this, I have to pick the best new character and I cannot. CANNOT.
See, we have so many options!
Option 1: A creepy adorable blue fuzzball who is hunted and persecuted for the way he looks. He also nearly gets straight up staked by an angry European mob, showing that this new iteration of the X-Men is a few shades darker than the last one. (I also feel that angry mobs happen a lot less in Europe than Marvel think they do, but hey.)
Tumblr media
Kurt, baby? You know you can teleport yourself out of becoming a human shishkebab, right?
Option 2: A woman who is too good for you. And for me. For anyone, tbh. She can control the weather and step on me. She starts out as a goddess and it’s the accuratest.
Tumblr media
Ororo Munroe is my religion.
Option 3: A Russian tin can man with a sweet, sweet heart. Soft boi in a hard shell.
Tumblr media
Also featured as a very early cameo: llyana Rasputin in dashing Soviet fashion.
Option 4: An angry Canadian who has authority issues and claws.
Tumblr media
Did you know? Wolverine was originally envisioned as an actual wolverine who was turned into a human being. I think we can all agree that this was the better option.
Option 5: An angry Native American who has authority issues and a very uninspiring power set. (Look, if your ‘super powers’ can feasibly be achieved by plenty of cardio and bringing along a well-trained labradoodle, I’m just not here for it.)
Tumblr media
John Proudstar does tell Xavier to go suck a cactus. Ten points to Gryffindor!
This cast is rounded out by some returning faces:
An angry Japanese guy who has authority issues and fire powers.
An Irish ex-thief/also ex-cop with sonic powers.
Why is this group instantly more interesting than the OG5? Well, instead of five vaguely generic teenagers coming from sort of similar backgrounds (upstate New York, wealthy, white), we have a couple of older characters coming with wildly varying histories. Some of them even provide a proper through line for the ways mutants fit into society: Nightcrawler is hated and feared, Storm is revered, Wolverine has been recruited by the government and Colossus lives among humans, presumably hiding his powers.
But why has Charles X gathered all these mutants? Because the X-Men have vanished on this mysterious tropical island! All except for an amnesia-riddled Cyclops, who returned to the mansion to go get help! Even though he’s not sure how he escaped, exactly.
The new X-Men travel off, and in between their introductions and embarking on the plane, Sunfire threatens to leave the team about three times.
Tumblr media
Sunfire, my man, you could've just stayed in Japan.
Important to note is that none of these mutants mesh well yet and, when they approach the island, Cyclops decides to pull a Fred and he splits up the team - precisely among the fault lines. Interestingly, none of these duos really get along: Sunfire, Wolverine and Thunderbird all have grumpy loner personalities, meaning they don’t play well with others. Sunfire manages to aggravate Kurt, who is possibly the easiest to get along with out of them all, and Wolverine, hilariously, has a really hard time with Bashee’s sonic shouting when Sean flies him down. But even Colossus and Storm, who will later end up one of the more powerful X-friendships, are unfamiliar, ill at ease in each other’s presence.
Anyway, odd shit keeps happening. The Blackbird Strato-Jet vanishes. Cyclops and Thunderbird deal with some stringly-strangly vines; Wolverine and Banshee fight with a giant crab, Colossus and Storm are threatened by a living avalanche and Sunfire and Nightcrawler get swarmed by ferocious birds. After these various altercations, each duo notices this huge temple (which wasn’t there before), almost as if some unseen force is leading them towards it.
At the temple, the new team reunites and there, they find the lost X-Men! And Angel promptly berates them for falling into this trap, because…
Tumblr media
Who's been messing up everything? It was Krakoa all along!
Krakoa is a mutant island that feeds off of mutant energies and it released Cyclops because it thought it would bring back more mutant snacks. (Which evidently worked, seeing how Scott brought back Kurt and Piotr.)
The X-Men release the X-Men and together, they band together in awesome (and sometimes confusing) artwork to fight Krakoa.
Tumblr media
Look, Angel's doing his best, okay?
In the end, mostly thanks to powerhouse Lorna, they launch the island INTO SPACE. And in the aftermath, Warren asks an important question:
Tumblr media
Split into two teams/books and become instantly iconic? No? Not for another twenty years?
Best new character: Don’t make me do this.
Fine.
Okay. So, I don´t think I can judge these characters without taking into account what will happen to them in the future, so I won´t even try. While I love Wolverine and Colossus, two of my ever-favorites are Storm and Nightcrawler. Nightcrawler, because he represents the best of humanity: even though it would be so easy for him to hate mankind because of their prejudice and their hatred, he always chooses kindness, faith and optimism. Storm, because she is a queen and will become one of the most complex and well-written comic book superheroes: a goddess, a thief, a leader and one of the best female power fantasies ever.
I choose her. I always choose her.
Ugliest costume: None. I do want to note just how well the costumes are designed here: Storm’s tiara-and-cloak outfit is still iconic and Nightcrawler’s and Colossus’ looks are so good that they are still being used, decades later. Hats off to Cockrum.
What to read: This. It’s just good. The new team is leagues better than the old one and the twist that the villain is Krakoa holds up. Sure, it’s all still a little wordy and nobody ever bothers explaining what’s up with Sunfire wanting to leave every second, but it’s an excellent reboot and a milestone issue.

YMMV but Lily was a stand in for Rowling. It's why the relationship with James is uncomfortable to read.
(I hope I guessed the meaning of stand in well because I am not totally sure)
In reference to this post about Gryffindor's (and JKR's) belief in their moral superiority.
Ah, yes op. I do think JKR wrote Lily as this, in her eyes, symbol of perfection for Harry, this symbol of goodness and kindness. I'm sure she saw her behaviour toward Severus as completely okay and positive, I'm sure she never questioned her writing of this apparently flawless character even during The Prince's Tale. But the fact she wrote Lily as flawless (more of a symbol than a character, honestly) doesn't mean she is actually flawless and we now know how problematic JKR's work can be.
I think, and this is a personal opinion, that JKR wrote Lily according to her standards of what a good person is like. Standards she also applies to herself, because she, as an author, and Lily, as her stand in character, have many similarities in the way they view the world and behave toward others. I am of course not comparing a real person and fictional character, but trying to show how one can influence the writing of a character - and what this person thinks of this character, which can be reflected through the narrative and main character's POV. Then, by extension, all of this strongly influences our own views on the character as readers, especially when reading the books for the first time. Some things that are disturbing to us and not understood by Rowling:
Strong belief in your own moral integrity: JKR seems to use her books as a weapon against those who point out her narrow-mindness, constantly reminding us she wrote them as a message of love and acceptance, "including" diversity in her world. She never questions her own behavior. She wrote Lily as morally flawless also because she is a Gryffindor and muggle-born: Lily, if you follow her narrative, is in her right to condemn and be critical of Severus' friends and choices, and to highlight her Gryffindor classmates moral superiority (ie they don't use dark magic) to justify the fact she grants herself the right to judge her friend and condemn his friends without addressing bullying. Because she knows better, and is moraly superior. Just as the narrative never really adressed the fact bullying by Gryffondors on a Slytherin isn't justified because they are "on the good side". JKR considers herself to be part of the Good People™, for many reasons, thus doesn't see any problem is writing blog posts explaining to some people why they are a threat to her own feminist fight or how they should behave. Of course I make NO comparison between her transphobia and a fictional character's behaviour; I'm just trying to show there is a similar pattern of behaviour which is, if I have to sum it up: I have moral integrity because [...] ➡️ So this moral superiority cannot be questioned ➡️ So this gives me the right to judge you/tell you how to behave without sweeping my own backyard.
Quick to condemn, unable to understand: This moral superiority (let's face it, Gryffindor are always portrayed as moraly superior in the books which nearly always justifies for discrimination against Slytherin) JKR thinks she has for reasons said above has for consequence the fact she gives herself the right to point out people's supposed flaws and "dangerous" behaviour without ever giving them time to explain, or listening to them. She sees what she wants to see, and so does Lily as she wrote her: the narrative makes of the fact she never gives Snape the opportunity to explain himself a normal thing, because we already know he is in the wrong; she already knows it and decided it, so why would she even ask?
Belief in your own right to judge and change people: for all the reasons I wrote above. You can question behaviours, you can point out flaws and issues: but you, as a person, cannot grand yourself the right to say "I know better than you do because this, this and this, so please change for me or I'll stop being kind to you." To JKR, this is perfectly acceptable behaviour (for example, "she knows and love trans people" but to the condition they remain silent and do not threaten her fragile views on feminism. If they do, she'll consider them a threat.) She writes Lily with a similar kind of behaviour regarding Slytherins: "without trying to understand who you are and why you are the person I see standing in front of me, without educating myself on your motives or asking for you pov, I ask you to change to match my own standards, no matter what it costs you."
Use of minorities, etc to serve personal aims and display your moral integrity: We have a whole history of JKR using sexual orientations or racial minorities to promote her work's open-mindness without ever giving them a voice or listening to them, trying to understand them. She writes Lily as a character who has such a good heart she is friends with Slytherin, dark arts affiliated Severus Snape and who knows it: "My friends (moraly superior Gryffindors) don't even know why I still hang out with you". ie "you should be grateful and their opinions have more values than yours to me." She points out her own benevolence at still accepting Severus as a friend, but never tries to understand Severus' own bravery and struggle at still being friend with her while having to survive in Slytherin house as a half blood (which was obviously more difficult). While reading this particular extract from the text, I cannot unsee the fact she (or JK) seems to think she does Severus a favor for being his friend (in context it's perhaps understandable), but it's very telling JKR would write this - we get the message as readers. The conclusion being, Lily had to be this moraly perfect girl as she had a Slytherin friend. I cannot say it's not implied by the narrative or it's not what JKR thought (she has lesbian and trans friends, so what she says cannot be discriminating/are justified by her supposed openness). Another disturbing and wrong way of thinking.
Belief that your belonging to one oppressed minority prevents you from oppressing others: JKR uses her identity as a woman in a patriarcal society, her statues as a woman who suffered from this patriarchy, to justify her transphobia and point out the fact she, as part of a group which is oppressed, do not oppress others (her blog post on "Why I'm not transphobic" is very telling). My feelings when I read Lily's character (but this may be interpretations from my part) is that her statues as muggle-born also automatically grants her moral integrity or at least a moral compass (narrative-wise) to be judgemental over Severus' relations and to decide whether or not the Marauder's actions toward him were serious: there is a kind of disturbing hierarchy that is created with Slytherin using dark arts and having prejudices against muggle borns (according to her) vs the Marauders and their pranks (not serious at all especially in comparison for her, and anyways they are Gryffindors). As if the fact she is the victim of oppressors means she doesn't have responsibilities or all she does is somehow justified or cannot mean ill (for example, turning her back on Severus while he is being sexually assaulted after he insulted her. She had a duty to perform as a prefect, which she wasn't even doing well before he said anything). The problem isn't her, she has reasons to act the way she does and flaws like all human beings. The problem is that the narrative (thus JKR) sides with her and never have us readers question her behaviour as well. It matches her inner belief that some people's moral integrity cannot be questioned for certain reasons. We are never offered another pov, we are never shown another perspective (of course Lily as a character isn't the one supposed to be this meta): for example, we could have been shown how easy it is to fall into radicalisation especially when you're an abused and neglected child from a poor social background and a minority. (Again I'm not saying it was up to Lily as a character to understand this. She had no obligation toward Severus and isn't all mighty and a Saint. The "problem" is that the narrative is trying to portray her as such because the author truly believes this is how a good person behaves and should be looked at.)
All of this of course being unconsciously accepted, but never put in question. Lily's behavior being of course viewed more positively because no matter how flawed it was, it served honorable aims: fighting against the disgusting blood purity ideology. Her values are honorable. So to me, of course JKR was convinced of Lily's human perfection and inherent goodness because I think she wrote her according to her own views and beliefs on the matter. Which is why, if we grant importance to the narrative, her marrying someone as crual as James Potter is disturbing according of what is said of her:
"Not only was she a singularly gifted witch, she was also an uncommonly kind woman. She had a way of seeing the beauty in others even, and perhaps most especially, when that person couldn't see it in themselves."
But, when you take a step back, you realise that her marriage with James is a consequence of JKR's internalised sexism, as she heavenly implied macho and possessive behaviour such as displayed by James were attractive to girls in the end, and, if you take another step back, you realize JK never understood the seriousness of the bullying she wrote so it didn't look so appealing to her that Lily would date James as it is to us.
Then, if we really think of the characters themselves and not JKR's intentions, I think James and Lily were a good match for various reasons, not all negative.
I'm afraid this is a little clumsy and I just really want to say, I'm not blaming Lily for her behavior even if we must acknowledge the fact she wasn't a very good friend and was very far from being perfect; I'm not making a comparison between real life issues and fictional ones, or between author and fictional character: I'm trying to show why Lily appeared as such a model of goodness into JKR's eyes, which shines through the way she tells the story, because she was written according to the writer's standards - some standards and positions we cry about every day when we open twitter. It's not really about her transphobia or use of minorities, but the reasons why she thinks she has a right to give judgemental opinions and ask people to change, her own system of thinking. Her - phobia are a consequence of this but I have to talk about them to show how it seems to me JKR thinks of herself and of others.
This is not anti Lily Potter, she still was a good person and lived in a particular context which also explains certain aspects of her behavior; this has nothing to do with making Snape look better or finding him excuses.
It has everything to do with the way the author viewed her characters and certainly failed to understand the seriousness and complexity of all subjects she chose to address. With the way she sees things and how her characters behave sometimes accordingly.
(Like, for example, not making any comparison, I'm sure she really thought it was positive when she created the house elves, slaves that are happy to be slaves and making fun of those who are disturbed by their conditions and having the only free elf die; I'm sure she thought the message was good when it clearly reeks of colonialist fantasy, thus her own opinions and views as a white British in the 90s [not generalising this to anyone else!], certainly internalised.)
PLEASE MAKE A DIFFERENCE BETWEEN "SHE WRITES LILY THIS WAY" AND JUST "LILY".

George Floyd is on my mind and in my heart.
What I knew before was damning enough. But there's so much more and it's shaking to the core.
It's moments like these where my perspective that there is no such thing as a "bad" or "evil" person. But I remind myself, saying someone is inherently evil is a scapegoat. Once one determines a person to be inherently evil, they've begun to already excuse any negative actions that person choices to take as just being part of the expectation of that person. I'm more interested in maintaining disappointment with every poor harmful choice, never lowering my standards bc that is how people literally get away with murder.
Stay shocked even if you had an inclination of what would happen. Even when you know, they don't have to know that you know. You can keep your expectations high.
Idk about you but I had been trained to believe the "good vs evil" of people, used to believe it was just a matter of sorting out the bad people and purging them. That is no way to think of humans who can all change at the flip of a leaf in the wind. While I'm not saying everyone will, we must recognize the fact that people have choices and that we need to not be mistaken in believing they didn't, or that their bad choice was inevitable in any way. Chauvin didn't just make one decision, he made multiple choices within 9 mins.
Chauvin made the choice to murder Floyd, who he was sworn to protect no matter what. Even if Chauvin thought of Floyd as a criminal he was still sworn to not let his personal perspective influence his job: to serve and protect with compassion.
Chauvin chose to sign his oath to swear: "I will never act officiously or permit personal feelings, prejudices, animosities or friendships to influence my decisions. With no compromise for crime and with relentless prosecution of criminals, I will enforce the law courteously and appropriately without fear of favor, malice or ill will, never employing unnecessary force or violence and never accepting gratuities."
Chose to view George as a threat rather than someone in need of the compassionate treatment
Chose to handcuff him.
Chose to kneel on his neck.
Chose to refuse to let up. Once. Twice. Multiple times from various onlookers.
Chose to threaten an EMT with pepper spray when they tried to approach to assist George.
Chose to grind his knee.
Chose to ignore George in crisis.
Chose to put George in crisis.
Chose to act as though George was in no danger, despite the judgement of several others - including those more trained in medical field
Chose to plead not guilty
Chose to attempt to avoid judgement for his choices, though he seemed to believe himself capable of judging George as a threat
Choices must have consequences, Chauvin should be held accountable for every. Single. Choice.

Lord Mil and Squire Ohm headcanons:
- While Tine and Prince Sarawat have their private “training” sessions, Lord Mil always invites Ohm to go for walks through the castle gardens at ungodly hours, mostly because Mil doesn’t sleep very well and Ohm talks his ear off without him needing to respond. This routine has happened most nights since they first met and they are both quite happy with the arrangement.
- Ohm is especially great with Mil’s horse. Mil has never gotten along very well with the animal and as soon as Ohm started working with it, the steed has become increasingly more loyal to even Mil. Lord Mil thanks Ohm for this by allowing him to take the horse out for a ride whenever he pleases
- Mil finds himself able to share almost anything with Ohm, without fearing that his Squire would think badly or speak ill of him
- Ohm notices that so many people misunderstand or judge Mil and, whenever he can, he speaks up against people’s prejudices of his Knight
- Lord Mil runs into a castle servant and his Squire alone together in the castle hallway one evening and is shocked by how nervous Ohm looks and how quiet he is, actively listening to the servant babble on about something. Mil makes a note to tease Ohm about it the next morning at practice and inquire further about the situation
- There is no one that makes Mil laugh harder than Ohm. He does especially accurate impressions of both Trainer Dim and even Prince Sarawat. Whenever Mil is feeling down, Ohm puts on a show to make him forget his worries
- When Ohm first met Lord Mil, he was terrified of the man but now, other than Tine, there is no one he trusts more than the Knight that he serves. He hopes he can always work at Mil’s side
- When Mil lends Ohm some of his formal wear, he can’t help but be shocked by how well his Squire cleans up. Mil would never tell Ohm, but he would even dare to call his Squire handsome
- Whenever he can, Ohm sneaks treats that he gets from Fong into Mil’s pockets so that the Lord finds them a snack later on. Mil returns the favor by bringing some of his Fathers fine wine to their midnight garden walks.
- Mil is not one to speak of his family or his childhood but for some reason he tells Ohm some stories of his difficult upbringing that he has never shared with anyone before
- After one month of working together, Mil gets a pin with his Bear emblem forged for Ohm to wear with his Squire gear. Ohm almost cries when Mil gives it to him
- Ohm often colludes with Phukong, encouraging the Prince to be more bold with his endeavors of Mil. Ohm also brings up Phukong on a regular basis just to see his Knight blush deeply, even at the mention of the Prince’s name
- Both Ohm and Mil trust each other with their lives which is why they make such strong partners
This is for @sarawatism Nen, I hope this brightens your day somewhat and sort of lives up to your MilOhm expectations 💙

Not sure if you’re able to help with this but... with all the recent scandals about idols these days, how would you suggest being able to come to terms with something an idol has done and still being able to stan them? (This doesn’t necessarily mean agreeing with their actions or defending them blindly bc ew) but rather acknowledging that they’re human and make mistakes yet still supporting them without going bonkers ? It’s really tough for me :(
Well I think it’s going to be a hard balance for everybody, honestly.
My hard take on idols is to ALWAYS consume their media from a distance. They are not my friends and I do not know them. If I think I’m being too involved in their lives, fantasizing too much about them, relying too much on them for my own well being I know it’s time to step back and reassess. I think this is always the first step to critical thinking because if you can’t look at them like human beings, if you’re clinging too much on the image they project, whenever they do something bad, as it is inevitable because no one is above this, celebrities even less, it will be harder for you to take on the situation the way you should.
I’ve said this to a mutual before, in light of recent problematic events, and what I think people should do is simply: take their time. There is no need to rush on anything. Some scandal came up about an idol you like? Sit back, take a deep breath and study. Read about what happened from multiple sources. Think calmly if this affects you, if this behavior is something you would allow on people close to you. If it’s something that targets a specific audience, read about what they think, both sides. Do not go on twitter.
A thing that personally bothers me when situations like these come up is the ‘okay but no celebrity is perfect they’re human’  knee jerk reaction because no shit. I know that. And I don’t give a fuck because if they’re human I can hold them accountable for basic human decency. I’m not in favor of cancelling people in blind rage, but giving them a metaphorical pat on the head because they’re my faves isn’t helping either. But I think you already know how to not do that.
So you’ve sat and you read and you thought as impartially as you can about The Problem. Do you think it arose out of ill intent? Or is the problem in question happening because the person, simply put, does not know better? And I’m not talking about irresponsible behavior like DYI and shit like that, I mean the microagressions every celebrity under the sun has commited and will eventually be called upon cancelation for it. To quote an arguement I saw once, there’s a giant wall between “this makes me uncomfortable”, “this is harmful but you seem really misinformed” and “this is actively malicious”. I do believe intent matters, and albeit I can’t tell for sure the reasons a celebrity did what they did, or said what they said, it’s usually clear when someone is a bigot or when they have not yet gone through the work of deconstructing lifelong prejudices. Which, for the love of GOD, is not a free pass to go ‘my kpop boy would never do that I know him :(’ bc I will deck you on sight.
THAT BEING SAID, was the problem brought up to the attention of the celebrity themselves? Did they apologize? Do they sound truthful to their apology? Or do they brush it off? Do not speak up at all? I think these are all factors that matter and only you can judge whether it was satisfactory or not. For me, when an idol apologizes for their behavior and promises to do better, it means a lot because I do not expect them to be as well versed in social matters as I am. But I do expect them to have the common sense of knowing when they misstep and correct it. To go back to a point I mentioned earlier: I permit flaws and misjudgment on the people close to me when done out of ignorance IF they listen to the people around them when told they fucked up. This is not a card people can play every other day, all the time. But things like this are never ending, and if I’m still fighting prejudices myself I can’t expect someone else to be on the ‘wokest’ level.
And lastly, I think, if any of this made any sense whatsoever, is to make peace with the fact that you’re never going to find a single piece of media out there that is perfect. Because every type of media is brought up to you by people, and people fuck up terribly and often. It is important to know you can enjoy something and be critical about it. You can like something despite its flaws. Sometimes entertainment is just that, entertainment, and not to be put under a hundred different microscopes to judge whether it is socially progressive enough or not. Also a lot of discourse on this website does not exist outside of here. The difference between stans from tumblr/twt and casual stans that only like something and do not engage in social media discourse is staggering. There’s never an authority over is this thing corrupted beyond redemption or can i still like it and not be cancelled by my love for it. You’re the only one who can decide for yourself. And I think if you’re this worried about it that you read this entire nonsense to see if it helps you reach some sort of enlightment you’re already on the right path jfiosjfisoejfs do not drive yourself mad trying to please everybody and enjoy what you like as long as you’re self conscious about its implications.

Nettles’ Character Sheet
it’s been 500 years since i did one of these, but! undercut it goes~
Character Chart Character’s full name: Nettles Nimue Willoweep Reason or meaning of name: Nettles comes from the plant! Since nettles sting, I was originally planning on having her be a lot more prickly. She still is kinda pokey now, tbh. “Willoweep” is just “weeping willow” but smashed together. It’s for the Aesthetic™. Nimue refers to the “lady of the lake” in the legend of king arthur, and because I thought it sounded cool. important to note is that she made up her current name herself, for story reasons Character’s nickname: none (aiden calls her various pet names later), though some people might attempt to call her captain willow. it doesn’t end well.  Reason for nickname: she just doesn’t care for nicknames much, (Aiden’s the exception because they’re overly sappy/joke around a lot with each other later) and she used to be a pirate captain- but isn’t anymore  Birth date: March 28th Sexuality: queer  Gender/pronouns: genderfluid, she/her (occasionally they/them)
Physical appearance Age: 37 How old do they appear: probably around that. Maybe a smidge older. Weight: still have no clue how weight works! She’s got plenty of muscle mass tho :V Height: 5’11” Body build: thinner frame but with plenty of muscle. She’s strong as frick, and more like a steel rod than a stick. plenty buff :3 Shape of face: i still don’t know how to answer this question lsdkjfs, but she’s got a longer face w/ a sharpish chin  Eye color: pale green! Glasses or contacts: neither Skin tone: light brown (african american?) + seafarer’s tan on top of it  Distinguishing marks: she’s got so many scars. So many. The most notable ones being “ligature” marks on her right wrist, and a burn on her neck/left shoulder. Predominant features: her hair is p eyecatching for sure Hair color: emerald/leafy green Type of hair: curly coils  Hairstyle: currently has it in dreadlocks (they look a lil vinelike!), parted to the right  Voice: Jess Glynne - Thursday (but can also sound piratey) Overall attractiveness: strong ex-pirate plant lady,,, pretty in a rugged kind of way,,, ough,,,  Physical disabilities: none Usual fashion of dress: pirate, but make it shades of brown/green and a bit less flashy Favorite outfit: dark brown “vest” (actually a dress top she tore the skirt off of) with green accent around front laces, cream off-the-shoulder shirt w/ green accent trim and flowy sleeves, dark brown pants, tan boots w/ straps and gold buckles, large belt w/ gold buckle  Jewelry or accessories: black hoop earrings, an emerald leaf shaped cloak clasp, and a staff made of woven grass (which can turn into a sword)
Personality Good personality traits: generally levelheaded, unafraid to tell people things when needed, determined, patient, ‘do no harm but take no shiz’ mentality, not usually quick to judge, generally easygoing, v dedicated to those she considers family, thinks well under pressure, gives good advice (most of the time), can be p charismatic Bad personality traits: tends not to have much foresight, can come across as aloof, really bad about opening up, keeps too much to herself despite tryna get better abt it, can sometimes overlook traits in favor of just being allies/friends, a lil too willing to get into a fight sometimes, can be too headstrong, lies easily to get out of things Mood character is most often in: contemplative Sense of humor: very dark, likes to playfully tease those she cares about, loves really long jokes, can get a bit crass on occasion Character’s greatest joy in life: currently her forest (teaching journal comes close second some days) Character’s greatest fear: her past coming back to bite her Why? She’s not so much scared of people finding out who she used to be, more uneasy about people using it against her. She doesn’t want people to walk out of her life, but like, if they do, she wouldn’t blame em. She just doesn’t wanna get thrown under the bus for what she did back during pirate days, and accused of being something she isn’t (at least, not anymore.) What single event would most throw this character’s life into complete turmoil? Losing journal, tbh. She already lost everything- including family- once. She’s not willing to walk down that road again. Character is most at ease when: out among her plants, or chillin in a tavern Most ill at ease when: near the ocean in any capacity Enraged when: people threaten her loved ones/home/etc, people hurt others due to prejudice, people cause destruction in her forest Depressed or sad when: thinking of her old crew, ruminating in her memories for too long, near the ocean, an old tree dies Priorities: keeping the forest safe, producing enough lucrative plants/herbs so she has on hand pocket money, making sure journal’s alright/settling in/has the help he needs if she’s not around to give it Life philosophy: everyone gets their comeuppance eventually, but that doesn’t mean you sit back and wait. Go knock some sense into em if they need it. Take care of people worse off than you, too. A bit of help gets people a long way. If granted one wish, it would be: to have turned back in that storm instead of charging on. Why? Half her crew wouldn’t be dead. She could’ve actually retired instead of stepping down due to catastrophic failure. Her familiar would be alive. Y’know, normal reasons. Character’s soft spot: plants, gold, shiny things, kids Is this soft spot obvious to others? Plants, definitely. The other things you’ll notice if you’re around her long enough Greatest strength: making a decision and seeing it through Greatest vulnerability or weakness: absolutely hates/has a really hard time opening up to other people  Biggest regret: rushing headlong into a storm she had no hope of conquering Minor regret: not travelling inland more when she was a pirate (not a huge deal to her, but it woulda been nice) Biggest accomplishment: either successfully maintaining a ship/captain’s title for ten years, or nurturing her forest from a wildfire charred landscape into a thriving woodsy landscape. Minor accomplishment: finding out how to return gold (if she stole it on accident) without being too weird about it Past failures they would be embarrassed to have people know about: she likely has a ton from her early pirating days. Learning to be a pirate wasn’t super easy all the time Why? She likes to think she’s a competent pirate now, don’t bring that stuff up, thank u v much Character’s darkest secret: dark magic has tempted her many, many times. It still does sometimes. And she almost gave in on a few of those occasions. Does anyone else know? No. they won’t, if she has anything to say about it.
Goals Drives and motivations: moving on aka shoving her past in a closet, being able to keep her forest/new loved ones safe, gold Immediate goals: keep up with her trade partners and her “cash gardens,” check the forest for abnormalities, make sure journ doesn’t need anything that day (and help if he do) Long term goals: keep the forest healthy, keep journal on the right track, continue expanding her budding network of plant trading, hopefully make some more actual progress with her issues How the character plans to accomplish these goals: keep up the “forest guardian” role, send letters to journ/visit him, meet more people, and learn to properly open up. And. y’know. Maybe steal some gold here n there as needed. How other characters will be affected: positively for her loved ones/partners! And maybe possibly probably negatively for those she doesn’t like. Perhaps.
Past Hometown: didn’t have a “town.” lived on ships/ports for her whole life till pirating Type of childhood: unstable, tbh. She was the kid of some merchant questors. Thus, she was always travelling around. Not much time to make/maintain friendships, bond with her parents, or do much besides help out. Any goofing off probably got her yelled at. Her headstrong nature meant she didn’t take kindly to that, so she ran away at 15. Pets: none First memory: the sound of waves. It’s something she’ll never forget, no matter what. Most important childhood memory: seeing pirates in the distance during a trade route! Scary, but she was also in awe of em Why: those pirates inspired her runaway swashbuckling plans when she was a teen! They also showed her an alternative to the dull merchant’s way of fulfilling questor urges. Childhood hero: probably some super well known pirate from a legend a book she smuggled onboard Dream job: anything that wasn’t being a merchant (turned into pirate tho) Education: really good at math, reading, keeping records, and reading the ocean. All thanks to her parents/seabound life! She taught herself plant magic rlly early on, and also learned a lot more things pirating (swordfighting, how to manage a crew, which quests are the most profitable, etc) Religion: Finances: parents took care of childhood finances. She was treasure/stolen loot funded until pirating crashed and burned in her late teen/early adult years~
Present Current location: forest outside Journal’s town. It spans many miles. Currently living with: herself :V Pets: none Religion: Occupation: forest guardian, plant merchant, magic mentor Finances: merchant life pays well enough when she needs it. And, like, she still goes and loots places from time to time. Just keep it quiet, m’kay?
Family Mother: Danielle Chamelea Teritip Relationship with her: though she was v busy, her mother always did her best to keep her daugher on track. She’s the one who pushed nettles really hard to learn, and to focus on becoming a better merchant than entertaining other fantasies. Their relationship wasn’t terrible, but nettles never felt her mom’s approval of her personal goals- just the future her mom wanted. Father: Albus Troise Teritip Relationship with him: he was also very busy, but always took the time to teach her little tricks and tips of the trade. He was also sorta pushy about her becoming a merchant. He never even seemed to notice her pulling away to other fantasies. Why would she? After all, your kid’s gotta carry on the family business. What else would she be doing? Siblings: Relationship with them: Spouse: Relationship with them: Children: Relationship with them: Other important family members: if found family counts, which it does, that’ll be journal! Later in the plot, it expands to fit aiden/roo/seraph/ruffy. In her past, her crew would all have been here
Favorites Color: green. Any shade. Surprising, i know Least favorite color: beige. Boring color, no thank u >:V Music: sea shanties!!! Also likes metal, some pop, and has a fondness for violin/flute music Food: a p p l e s. Also fond of any produce she can eat raw. And crabs. Lov the cronch. Literature: prefers oral stories to reading. But like, history is super interesting to her. Form of entertainment: oral storytelling, showing off (or watching someone show off) magic, stupid tavern karaoke Expressions: loves that devilish smirk of “oh no, they’re up to something bad, hold onto your valuables.” also enjoyable is that eyebrow raise of “did you really just do that? Really? That?” with a deadpan face. Peak expressions. Mode of transportation: swinging/parkouring around through the trees via plant magic and vines, like tarzan, except the vines yeet him instead of swinging sometimes Most prized possession: her staff. She’s had it for years, through good and bad, and it’s not going anywhere. May or may not also have a feather in her cloak clasp for… reasons.
Habits Hobbies: gardening, swordfighting, people and/or birdwatching, storytelling, being extra as all frick every so often so people don’t forget u can and will take them the frick out, applepicking Plays a musical instrument? nope! Plays a sport? Does swordfighting count? How they would spend a rainy day: either inside a town building, tavern, or little canopy of leaves in the forest. Depending on the setting, she’ll just have casual conversations or peoplewatch. Or, if she’s in the forest, she’ll entertain herself with vivid storytelling. Sometimes she’ll jus watch whatever crawled into her dry canopy with her. Or bug journal with excessive letters. Anything chill slkdfjs Spending habits: if she can grow/make/wash it herself, she’s not buying. Spends more gold on trips to town restaurants/taverns than anything else, but it’s chill. ‘S not like she has rent to pay :V Smokes: nope Drinks: rum, of course. What kinda pirate do u take her for??? Also wouldn’t mind whiskey. Drinks a lot less now than she used to. Other drugs: nope What do they do too much of? Being a local cryptid What do they do too little of? Opening up to other human beings instead of plants Extremely skilled at: reading a room, cutting to the chase, sword-and-regular-fighting, plant magic, teaching, stealing/pickpocketing, thinking on her feet Extremely unskilled at: planning ahead, knowing when she should really let things be instead of starting smth, letting her loved ones fight their own fights (she’ll try and step in at least once) Nervous tics: going silent, putting a hand over her mouth, staring really hard at nothing, holding her staff close, squeezing anything in hand (usually her staff end) Usual body posture: holds herself loosely but confidently. Has the air of someone who knows what’s going on, and is at ease wherever. Mannerisms: usually blunt, teases those she cares about (unless told not to), makes hand motions when explaining things, speaks in a more “normal” voice most of the time but can occasionally slip into a piratey accent when angry/upset, tends to unconsciously mimic the accents of those around her if she’s in a new setting, likes to sit back and watch until she judges herself to be “familiar” enough with what’s up Peculiarities: the smell of a lotta salt can sometimes upset her, she’s an extrovert but spends most of her time in the woods/outskirts of towns, she’s still very superstitious from her pirate days
Traits Optimist or pessimist? Tends to err on the side of pessimism nowadays Introvert or extrovert? Big extrovert! She’ll spend time just hanging around places people are if she feels too drained, and really loves spending time with those she cares about Daredevil or cautious? Daredevil with an air of caution about her Logical or emotional? Likes to think she’s more logic based, and acts it, but she’s very emotional driven when it comes down to it Disorderly and messy or methodical and neat? Very neat, actually! You wouldn’t know it unless u got her to live inside tho ¯\_(ツ)_/¯ Prefers working or relaxing? Mix of both. Enough work so she’s not bored, but enough relaxing so she’s not stressed :V Confident or unsure of themself? Confident for the vast majority of the time. Animal lover? She’s definitely fond of em!!! :D
Self-perception How they feel about themself: eh, she’s alright. It fluctuates some days, but tends to rest firmly in the “I’m fine, and if I’m not, I’ll fix it for tomorrow” realm. If it does fluctuate, she either feels like a traitor/liar, or a cunning bada$$ One word the character would use to describe self: survivor One paragraph description of how the character would describe self: “I’m Nettles, Nettles Willoweep. I’m a thirty seven year old sorceress who likes plants more than people. Well, that’s a lie. But it is easier to deal with foliage sometimes. I used to be a pirate a long time ago. Not so much nowadays, but that’s not to say I won’t bend a few rules in a pinch. I do what I need. After all, who’s gonna miss a few coins here and there? Certainly not the other families I slip em to. But uh, hey, don’t go spreading that around. I’ve got a reputation to upkeep.” “I guess I’m a bit of a benevolent local cryptid? Whatever that means. Journal tells me it’s a good thing, and I’ll believe him for now. I’m certainly doing what I can to take care of people who need it, and I’d give my right arm to help those I’m close to. Yeah, my blood runs a little hot sometimes, but that hasn’t changed my whole life. I just wanna see my plants and people prosper, and maybe get some gold on the side.” “... ah, right, hobbies. Gardening, forest guarding, fighting with swords, birdwatching… lots of stuff. As long as I’m not spending all my time slogging through old wounds, i’ll call it a good day.” What does the character consider their best personality trait? Her dedication What does the character consider their worst personality trait? How easily she brushes off concern What does the character consider their best physical characteristic? Not sure! She likes her body, and has no complaints abt it. Maybe her hair or how limber she still is :V What does the character consider their worst physical characteristic? ¯\_(ツ)_/¯ How does the character think others perceive them: she thinks the general public perceives her as shady but mostly benevolent. She thinks her loved ones perceive her as blunt, but caring. Both of these are fair analyses, by her thought. What would the character most like to change about themself: make it so she could forgive herself easier, and admit to others that she needs a hand
Relationships with others Opinion of other people in general: people are easily tricked and dumb. Individuals can be p nice tho. Does the character hide their true opinions and emotions from others? She’s one of those people where, in certain situations, you’re never gonna be sure if she’s being sarcastic/truthful or not. She does it more regularly than she would like, but less so with close friends Person character most hates: i could put some old rival of hers here. Unfortunately, ‘herself’ works better :( Best friend(s): she’s very good friends with several bartenders, but especially the one in journ’s town. She’s hit it off quite nicely with a nomad who passes through every couple weeks or so, too. Journal is also a “best friend,” but like, in a mentee/kid kind of way Love interest(s): aiden, later ;3 Person character goes to for advice: bartender bffs Person character feels responsible for or takes care of: journal journal journal journal jo- Person character feels shy or awkward around: nobody :V Person character openly admires: *insert several pirates/legendary sorcerers/questors/casual hard workers in towns here* Person character secretly admires: eh. Probably aiden for a bit. Wink wonk lskjdfs Most important person in character’s life before story starts: technically journ counts here? But if not, just herself. After story starts: journal for sure

Audrey Did Nothing Wrong
No, really. She didn’t. Not prior to “Queen of Mean” anyway.
I recently realized that for all the makers of the Descendants series did to portray Audrey as unlikable, she never actually did anything that was truly unlikable. Prior to her turn to campy magical villainy, here are all of Audrey’s supposedly bad actions across the whole film series:
- Made passive-aggressive remarks to Mal and gave the unsubtle vibe that she didn’t think much of her throughout their first meeting. The issue here is that Mal did the exact same thing, at the exact same time, with just as little prompting other than who the other girl’s family was. Yet Audrey’s meant to be seen as a bitch in that moment, but Mal isn’t!?
- Told Ben to not be so nice and trusting toward Mal, saying that unlike the story of his parents, in her parents’ story “the evil fairy was just the evil fairy”. But here’s the thing: she’s right at the time she says this. Judging someone based on who their parents are is dumb, but the fact remains that Mal had not shown any signs of being trustworthy or repentant of her delinquent attitude, and as Audrey spoke was actively scheming to put a love spell on Ben as part of an evil plan to steal the Fairy Godmother’s wand so that her mother could conquer Auradon. And Mal, unlike her cohorts, is really invested in doing this. There is no valid reason for Ben to think that Mal is actually good, other than him being the designated love interest.
- Continued to dislike and distrust Mal and co. for the rest of the movie...and again, rightfully so, because they ended up going almost all the way through with their villainous plot, only backing out and saving the day at the last possible moment (and if you fall back on the “but that’s how they were raised!” defense, then you need to cut Audrey some slack to since she was raised to believe the worst of the Isle of the Lost’s inhabitants). Ben publicly dumping her for Mal, which she would later learn was because Mal put a love spell on him, didn’t do Mal any favors when it came to Audrey’s opinion of her.  And I feel like it should also be noted that this dislike and distrust was always kept to words said toward other people, Audrey never directly antagonized the VKs the way that Chad or even her own fucking grandmother did.
- Said a lot of bad things about Mal behind her back when getting a make-over at a forest salon. It’s not a crime to speak ill of those you dislike in private (Uma does it about Mal all the time and nobody’s getting on her case about it), and Audrey has a totally justifiable reason to dislike Mal. Also, note that the reason she was getting a make-over was to hopefully convince Ben to take her back. Between Mal, Uma and Audrey, Audrey is the only one whose strategy to win Ben’s heart in order to achieve her personal desires in life did not involve using magic to strip him of his agency. As she herself says in her famous song, she “follows all the rules”.
- Confronted Mal after Ben proposed to her and made a nasty crack about how Mal and Ben’s relationship only started because Mal put a love spell on him (”touching story for the grandkids”). There is nothing untrue about what she said, and she did this only after being required by law to attend this event, watch Ben propose to Mal while singing a brief reprise of the song he sang when he broke up with Audrey and publicly humiliated her under the love spell’s influence, have her grandmother express how disappointed in her she is that she failed at what she was raised to believe is her life’s purpose (and failing due to the daughter of her family’s mortal enemy, at that), and having absolutely no-one around her even attempt to comfort or console her despite how clearly in pain she was. And when Audrey confronts Mal with the harsh truth, Mal just walks away instead of apologizing for wronging Audrey.
So why is Audrey vilified by people even before she became an actual villain?
Three reasons, all cheap tricks to distract from the truth:
1. Mal is the main character, her POV is the one the movies are mostly shown through, and this creates a bias in many viewers. Since Audrey’s POV is not highlighted and she is mainly seen from Mal’s perspective, people cheer Mal on and boo Audrey without realizing that none of Audrey’s actions are wrong and that she has been wronged by Mal, who is constantly doing the wrong things and yet always ultimately getting absolved and even rewarded for it.
2. Audrey is given the high-strung, egotistical “Alpha Bitch” attitude which many viewers will immediately associate with being bad and mean, and so that’s what they consider Audrey to be even when none of her actions reflect this. Audrey’s attitude comes from her being raised to believe she’s a queen-to-be and thus higher above everyone else. There’s no malice behind it, it’s simply how she was brought up. She even expresses this herself: “I never thought of myself as mean, I always thought that I would be the queen”. Mal and the VKs actually perpetrate wrongful actions, and yet they can be excused by the “it’s because of how they were raised” defense, but that same defense can’t apply to someone whose biggest “crimes” are making snarky comments and displaying an immature superiority complex?
3. The whole dichotomy between the people of Auradon and the Isle of the Lost, where the latter are portrayed as a wrongfully oppressed and downtrodden lower class and the former as their privileged, prejudiced and hypocritical overlords. Audrey is thus seen as just a spoiled brat and a bigot without any empathy for the less fortunate, and Mal as the hero who will upend the status quo for the better. Once again, the double standard in kids being reflections of how their parents raised them is at play (because that’s where Audrey’s prejudice comes from), but another thing that is conveniently glossed over is that Mal was always privileged.
On the Isle, she was the daughter of its leader, Maleficent, who had inherited her magic powers and thus could and did boss all of her peers around and make trouble as she pleased, since she could get away with it. People like Uma, with less power than Mal, were victims of her bullying. In Auradon, Mal just became even more privileged, even when she didn’t truly deserve it (again, she ended up getting rewarded for casting a love spell on Ben and for saving Auradon from the peril she willfully brought upon it, to say nothing of her amazingly selfish fuck-ups in the sequels). So who’s the sociopathic oppressor here?
I have no idea what Kenny Ortega and the rest were going for with Audrey’s character, but she deserved better than to have all of her legitimate grievances buried by cheap tricks to cast a negative light on her and then made a real, full-on villain all so that people can root for the problematic main couple against her. Kind of like another princess character I know.

ABLEISM REDUX
Well… There are so many different dimensions of disability that people can be ableist toward those with different disabilities than their own. …And it’s only in the last couple of generations (within my lifetime, at least) that Disability Rights groups have banded together in a common cause (Rather than, say: Rights groups for the blind working only for the blind, Rights groups for Cerebral Palsy working only for Cerebral Palsy, etc.).  Matter of fact, based on my own recollections, I think working together for universal access rights only really got any steam in the 1970s – when I was already a teenager.
Confession time: until relatively recently (like, the last 10 years, or so), as a physically disabled person, I was biased against those with intellectual disabilities, and would get quite insulted if anyone mistakenly thought I was “R
—–ed.”
@theborkplanet IDK HOW TO SEPARATE MY COMMENTS FROM YOURS AND COMMENTS FROM YOURS. HENCE THE CAPS.
I WAS ALSO BIASED AND PROBABLY STILL AM SOMEWHAT, TOWARD PPL WITH INTELLECTUAL DISABILITIES(ID). I TOO USED THE R WORD. GROWING UP MY EXP WITH PPL W/ ID WERE NEGATIVE OR GROSS, AND NO ONE EVER BOTHERED TO EXPLAIN SOMEONE’S ID TO ME, SO ALL I KNEW WAS NEGATIVE BEHAVIORS EG JO GRABS STUFF AND SCREAMS; NO ONE EVER EXPLAINED HER AUTISM. MOE HAS DOWNS SYNDROME, IS OBSESSED WITH SAYING “BOOBIES” LOVES THE EFFING BEACH BOYS AND FARTS A LOT AND NEVER SHUTS UP; HOW ANNOYING; NO ONE EVER TOLD ME ABOUT PERSEVERATING, OR THAT DS CAN CAUSE GI PROBS SOMETIMES. AL MUTTERS, HE STINKS, AND HE KNOCKED OUT HIS AIDE SO I’M AFRAID THAT AL WILL GET ANGRY WITH ME AND KNOCK ME OUT; NO ONE EVER EXPLAINS HIS CONDITION, SO I GLEAN MY INFO FROM EAVESDROPPING and RUMORS. THE ABLE-BODIED ADULTS DIDN’T BOTHER TO PROMOTE UNDERSTANDING EVEN THO WE WERE ALL TRAPPED ON THE SAME SPECIAL ED BUS, SO THE PASSENGERS WITHOUT ID TALK SMACK ABOUT THE ONES WITH ID. THE ONE TIME I ASK, “WHAT’S AL HAVE?” ABLEBODIED ADULT SHAMES ME FOR ASKING AND BLATHERS ABOUT CONFIDENTIALITY. NOT TRYING TO JUSTIFY MY PREJUDICE; JUST RELATING EXP. I’M ALSO WORKING THRU IT BUT U R RIGHT; NEVER 100% DONE.
I’m working through it, and like to think I’m getting better (and one huge part of that is learning just how deep and intertwined institutionalized ableism really is, in our societies). But as with being a White woman dealing with racism, I have to remember that it’s a case of continuing recovery, and not something I will ever be 100% over and done with.
Thanks for sharing, @aegipan-omnicorn. You’re lovely.
@bigbluebarns, I don’t personally know anything about suffering racism, being a white american myself. However, I do know a thing or two about suffering ableism, both at the hands of able-bodied people, and disabled people.
People are incredibly social animals and will band together in groups with other similar people. This is natural, and it is good. It can be healing and cathartic to hang out with people who “get it.” But this tendency can also have an extremely dark side, as we see with “isms.” This is going to get long, so I’m going to break it here in consideration of people’s dashboards. Again, I can only speak to ableism and sexism so please keep that in mind.
OMG, I LOVE THESE NAMES AND TRADEMARKS. DID U INVENT THEM?
Ableisms I have suffered at the hands of disabled people:
The Cripple Police™: These are the people who, in an overzealous bid for limited access available, arbitrarily decide who is disabled enough to use a mobility aid, bathroom stall, parking spot, and even sometimes the label of “disabled.” If you are not Crippled Enough, you can be subject to any form of social punishment they deem to be necessary.
I HATE THE CP AND I’M CONSTANTLY REMINDING PPL THAT U DO NOT HAVE TO APPEAR DISABLED IN ORDER TO USE HANDICAP PARKING. IT’S LIKE THEY WANT U TO WEAR A TAG STATING U R DISABLED SO THEN THEY CAN ASSESS IF U MEET THEIR RANDOM CRITERIA.
Example: I used to be able to walk longer distances with a service dog, but was still a high fall risk. My doctor (a licensed neurologist) prescribed me a parking placard so that none of us had to worry (as much) about me passing out in a parking lot where no one could see me, and getting run over. A lovely woman in a wheelchair, who just happened to park in the accessible spot next to me, proceeded to scream at me and my service dog all the way into the store. A manager rescued me by going along with my ruse of knowing him, and invited me into the back were I fucking hid away until they told me she had left the store. It. Was. Scary.
EGAD SOUNDS HORRIBLE. BUT YEAH THERE IS A DISABILITY HIERARCHY
The Born This Ways™ : The experience between people who were born disabled, and who acquired disability later in life, vary a great deal from one another. BTW ableist types actively minimize the experiences of other disabled people, simply because they hadn’t been baptized since birth by xyz. In other words, the suffering was not identical to their own, thus must be invalid.
Example: I became disabled after adulthood, and tried to find solace after being subjected to ableist responses from friends and family members who were unable to cope with the “broken me.” I found lots of great disabled people who helped me, but I also found people who routinely scoffed at my experiences, again informing me that I was not “disabled enough,” and suggested I was being deliberately weak, or histrionic. Sometimes it was almost eerily word for word what my ableist friends/family said. How strange…
I’VE SEEN THE ACQUIRED DISABILITY IS BETTER. TM ADIBS MIGHT IMPLY, “WELL I’M A QUAD, BUT AT LEAST I GOT TO EXP BEING ABLEBODIED; I’LL HAVE EXP U SADSACK LOSER BTWS WILL NEVER HAVE. I GOT TO BE NORMAL FOR A WHILE” MOST OFTEN I SAW IT COME FROM PARALYZED PPL WHO WISHED THEY COULD WALK AGAIN. I WAS BORN WITH CP AND AB PPL ACTUALLY ASKED ME “WOULD U RATHER BE BTW OR AD?” BEFORE I THOUGHT ABOUT IT, I SAID “BTW, CUZ THATS ALL I KNOW AND I’VE HAD IT FROM DAY1 FALSE EQUIVALENCY WHEREAS ADIBS HAVE TO ADJUST” NOW THO I KNOW THAT EVEN I AS BTW HAVE HAD TO ADJUST TO CHANGING SYMPTOMS. DO U WANT 2 BE A TREE OR A MOUSE...UHHH...FALSE EQUIVALENCY ALERT, CAN’T COMPAPARE APPLE N ORANGE.
The Faker Police™: I think anyone with an invisible illness has experience with this one. This is when people who “look disabled” refuse to believe someone who “does not look disabled,” and proceed to treat them as hysterical attention seekers instead of…well, anyone else. These people often practice double ableisms–I have noticed that many also tend to judge Disabled Enough based on mobility aids. Then, they try to chase the “fakers” out of the community, because everyone knows “fakers” are why we have additional burdens added (like further hurdles to access, government aid, etc).
ALSO IF U HAVE AN INVISIBLE DISABILITY LIKE YOURS AND ME ALSO, I SEE THE “WELL EVERYONE GETS DEPRESSED/SAD/TIRED.” I END UP FEELING LIKE I HAVE JUSTIFY THE DISABLING NATURE OF MY DEPRESSION/ANXIETY TO A WEG.
Example: Before my condition had progressed to me needing a mobility aid, I was already facing discrimination in the workplace. I requested an accommodation to have the crappy fluorescent lights removed from above my desk, as they provoke bad neurological symptoms. You’d think it was a little thing, but when I asked for advice on dealing with skeptical and belligerent management, I met the same reactions in some disabled people, followed immediately by “Fakers like you are why we see knee-jerk reactions like the word ‘no!’ Come complain when you’re actually disabled and need to have a ramp installed! Until then suck it up!”
The Totally Qualified Disability Judges™: This one seems to arise from the natural tendency of people to compare their situations to the situations of others. If they arbitrarily judge another person’s situation to be better or more favorable, then that person is not As Disabled, or Disabled Enough, or Disabled At All. Then, based on that judgment, they try to socially punish the condemned, or to excommunicate them.
Example: Some conditions are really straightforward and don’t vary widely. People with the condition all seem to have similar limitations. My condition is the exact opposite of that. I have the chronic form of migraine disease. Lots of people get migraines, but not all of them have more than 15 a month, and migraines can last anywhere from a few hours to three days. To some people, pain is the most disabling feature of a migraine, to others, the accompanying neurological weirdness is. (Migraines are often proceeded by cortical spreading depression, a phenomenon also exhibited in epilepsy. Just for an example).
So, when people hear what my condition is, they remember that one lady they used to know who had to lay in the dark for a couple days each month, and wonder why the hell I’m in a wheelchair. It doesn’t make sense to them (who cares that migraines don’t make sense to the most brilliant neurologists in the world), so they decide that I just must not be disabled. Or, if I am, it’s hypochondria.
I’VE SEEN: YEAH HAVE U TRIED XYZ CURE? IT REALLY HELPED THAT 1 LADY. IF U DON’T TRY XYZ WELL THEN UR LAZY N ALSO PROBABLY FAKING THE EXTENT OF UR DISABILITY?
Fun fact: Internalizing ableism from medical doctors, and from some close friends and family, and THEN the disabled people I came into contact with later, and from whom I seeked guidance, prompted so much self doubt that I had a licensed psychologist work me up for hypochondria and other related psychological conditions. It…turns out that I am not a hypochondriac. I could not find relief from all of these experiences until I encountered a neurologist familiar with my condition, and fellow disabled people who have been around the block, and who are not so embittered by their experiences that they deigned to expose others to the same.
For that reason, I will always be vocally critical of ableism within our community. I will not sugar coat it, nor will I flatter ableist disableds by giving them another name. That goes for my own ableism, too. Now that I have worked through a lot of my own, I can use my aids with confidence and obtain a freedom that is at least emotionally similar to the one I had when I first formed my adult identity (which was as an abled person).
AH YES, IN MY CASE, INTERNALIZED ABLEISM=ANXIETY N DEPRESSION. STILL NOT SURE IF DISABLED PPL CAN BE TECHNICALLY DISABLED BUT THAT’S JUST LINGUISTIC SEMANTICS.
CLEAERLY WE BOTH KNOW DISABLED PPL ARE CAPABLE OF ASSHOLERY.
CAN SOMEONE TELL ME HOW TO BOLD TEXT IN POSTS? #TUMBLR NOOB
For an example of sexism from women, see my post Never Underestimate Old Women, in which an old lady cashier schools us for self-righteous activism.
Thanks for the discussion!

Preclusion: Expanding Upon the Kessler Doctrine
by Dennis Crouch
In In re PersonalWeb Techs. LLC, 2019-1918, 2020 WL 3261168 (Fed. Cir. June 17, 2020), the court reinvigorates the Kessler Doctrine — holding preclusion is triggered even in cases voluntarily dismissed (with prejudice) by the patentee and is subsequently operable to block actions against subsequent allegations of infringement against the original defendant its customers. The doctrine is seen as a gap-filler for a situation not covered by either issue or claim preclusion.  Another similar gap-filler (is) was defense preclusion. However, the Supreme Court in Lucky Brand Dungarees, Inc. v. Marcel Fashions Group, Inc., 140 S. Ct. 1589 (2020) held that defense preclusion does not exist as a stand-alone doctrine going beyond the traditional notion of issue and claim preclusion. Although a substantially parallel situation, the court here does not cite or mention Lucky Brands.
= = =
Res Judicata (claim & issue preclusion) always involves at least two actions.[1]  In the first action some judgment is reached.  Later, in the second action the court is asked to skip over and not re-litigate claims & issues that were already finalized in the first action.  In this context, claims are thought of as the broad causes of action; issues are typically narrower but may be any legal or factual determination by the court.
The First Action: Back in 2011, PersonalWeb sued Amazon for patent infringement – alleging use of Amazon Web Services infringed several PersonalWeb patents.[2]  After an adverse claim construction ruling, PersonalWeb stipulated to a dismissal of its claims against Amazon with prejudice. In ordering dismissal, Judge Davis wrote: “Pursuant to Federal Rule of Civil Procedure 41(a)(1)(A)(ii), all claims … are dismissed with prejudice. Defendants Amazon.com, Inc. and Amazon Web Services LLC retain the right to challenge validity, infringement, and/or enforceability of the patents-in-suit via defense or otherwise, in any future suit or proceeding.”  Since no particular issues were finally decided by the court, we can immediately conclude that the doctrine if issue preclusion won’t apply to this case.  However, a stipulated dismissal by the court still leads to claim preclusion.
We know right away that PersonalWeb is not going to be able to sue Amazon again alleging that the same acts accused in this first case constitute patent infringement. One trick of patent law though is that each unauthorized making or using of an invention constitutes a new act of patent infringement.  And, the Federal Circuit has generally limited the scope of claim preclusion to the particularly accused infringing acts. “We have held that claim preclusion does not bar a party from asserting infringement based on activity occurring after the judgment in the earlier suit.”[3]
The Second Action: Since Amazon won the first case, it continued to sell its Web Services.  No surprise.  But, these are new (alleged) acts of infringement even if not substantially different.  In 2018 PersonalWeb filed “dozens of new lawsuits” against a collection of Amazon’s customers. These cases were consolidated by the Judicial Panel on Multidistrict Litigation with pretrial proceedings before Judge Freeman (N.D. Cal.).  The district court partially dismissed the case – holding that PersonalWeb was precluded from suing Amazon’s customers for taking the same type of action accused in the original Amazon case (even the customer action was taken subsequent to the Amazon case).
The Kessler Doctrine: Claim preclusion does directly protect Amazon’s customers here because their accused infringement – even if functionally the same – was not within the scope of the first action. Still, the district court found preclusion under the Kessler Doctrine. See Kessler v. Eldred, 206 U.S. 285 (1907).  Kessler – as interpreted by the Federal Circuit – is a “gap filling” form of preclusion and allows “an adjudged non-infringer to avoid repeated harassment for continuing its business as usual post-final judgment in a patent action where circumstances justify that result.” Brain Life, LLC v. Elekta Inc., 746 F.3d 1045 (Fed. Cir. 2014). Separately, the Federal Circuit has identified the doctrine as a “necessary supplement” to the traditional principles of res judicata.
[W]ithout it, a patent owner could sue a manufacturer for literal infringement and, if unsuccessful, file suit against the manufacturer’s customers under … any [patent] claim or theory not actually litigated against the manufacturer as long as it challenged only those acts of infringement that post-dated the judgment in the first action. That result would authorize the type of harassment the Supreme Court sought to prevent in Kessler when it recognized that follow-on suits against customers could destroy the manufacturer’s judgment right.[4]
Note here, that the “gap” would be filled by issue preclusion if the case had been pursued to a judgment of non-infringement.  Here, however, PersonalWeb dismissed its first action (with Amazon’s express consent) before the court could reach that judgment.
In addition to the temporal issue, Kessler also addressed the customer situation – finding them sufficiently in privity for the purposes of applying preclusion.
On appeal, PersonalWeb argued that the Kessler Doctrine should not be triggered by a voluntary dismissal. Essentially, PersonalWeb questioned whether the Kessler-type preclusion should be seen more akin to issue preclusion (express judgment of the issue required) or claim preclusion (triggered simply by a final judgment, including settlements). The Federal Circuit agreed with the lower court that a settlement is sufficient to create preclusion under Kessler and the Federal Circuit’s progeny. (Distinguishing license in Mentor Graphics).
The policy that drove the Supreme Court’s decision in Kessler would be ill-served by adopting the rule proposed by PersonalWeb. The Court in Kessler recognized that even if a manufacturer of goods were to prevail in a patent infringement suit, the manufacturer could be deprived of the benefits of its victory if the patentee were free to sue the manufacturer’s customers. The Court asked rhetorically whether, after Kessler had earned, “by virtue of the judgment, the right to sell his wares freely, without hindrance from Eldred [the patentee], must Kessler stand by and see that right violated … ?” Kessler. To allow follow-up suits by the patentee against Kessler’s customers, the Court explained, “will be practically to destroy Kessler’s judgment right.” Accordingly, the Court concluded that, setting aside “any rights which Kessler’s customers have or may have, it is Kessler’s right that those customers should, in respect of the articles before the court in the previous judgment, be let alone by Eldred, and it is Eldred’s duty to let them alone.” As the Court put the matter a few years after Kessler, a party that obtains a final adjudication in its favor obtains “the right to have that which it lawfully produces freely bought and sold without restraint or interference.” Rubber Tire Wheel Co. v. Goodyear Tire & Rubber Co., 232 U.S. 413 (1914)[5]
Although the Federal Circuit has spoken of Kessler in the form of preclusion, it has also provided the analogy of shop rights – a “limited trade right” that is attached to the product that “extends to protect any product as to which the manufacturer established a right not to be sued for infringement.”
In the end, the Federal Circuit provided an important caveat – parties are free and empowered to draft their settlement agreement in a way that overcomes the Kessler doctrine. [I]t can do so by framing the dismissal agreement to preserve any such rights that the defendant is willing to agree to. Settling parties will remain free to limit the preclusive effect of a dismissal; they simply have to fashion their agreement in a way that makes clear any limitations to which they wish to agree as to the downstream effect of the dismissal.”[6]
= = = =
[1] Res judicata is somewhat poorly defined. Sometimes it particularly refers to the doctrine of claim preclusion. At other times it refers more broadly to both claim and issue preclusion (and perhaps to other preclusion doctrines as well). The Supreme Court in Lucky Brand Dungarees, Inc. v. Marcel Fashions Group, Inc., 140 S. Ct. 1589, 1594 (2020) recently walked through this explanation.

My Tuesday Daily Blessings
June 20, 2017
Be still quiet your heart and mind, the LORD is here, loving you talking to you...........
Tuesday of the Eleventh Week in Ordinary Time (Roman Rite Calendar)
First Reading: 2 Cor 8:1-9
We want you to know, brothers and sisters, of the grace of God that has been given to the churches of Macedonia, for in a severe test of affliction, the abundance of their joy and their profound poverty overflowed in a wealth of generosity on their part. For according to their means, I can testify, and beyond their means, spontaneously, they begged us insistently for the favor of taking part in the service to the holy ones, and this, not as we expected, but they gave themselves first to the Lord and to us through the will of God, so that we urged Titus that, as he had already begun, he should also complete for you this gracious act also. Now as you excel in every respect, in faith, discourse, knowledge, all earnestness, and in the love we have for you, may you excel in this gracious act also.
I say this not by way of command, but to test the genuineness of your love by your concern for others. For you know the gracious act of our Lord Jesus Christ, that for your sake he became poor although he was rich, so that by his poverty you might become rich.
Responsorial Psalm: Psalm 146:2, 5-6ab, 6c-7, 8-9a
"Praise the LORD, my soul."
Verse before the Gospel: John 13:34
Alleluia, Alleluia
"I give you a new commandment: love one another as I have loved you."
Alleluia, Allelluia
Gospel: Mt 5:43-48
Jesus said to his disciples: "You have heard that it was said, You shall love your neighbor and hate your enemy. But I say to you, love your enemies and pray for those who persecute you, that you may be children of your heavenly Father, for he makes his sun rise on the bad and the good, and causes rain to fall on the just and the unjust. For if you love those who love you, what recompense will you have? Do not the tax collectors do the same? And if you greet your brothers only, what is unusual about that? Do not the pagans do the same? So be perfect, just as your heavenly Father is perfect."
**Meditation:
What makes the disciples of Jesus different from others and what makes Christianity distinct from any other religion? It is grace - treating others, not as they deserve, but as God wishes them to be treated - with loving-kindness, forbearance, and mercy. God is good to the unjust as well as the just. His love embraces saint and sinner alike. God seeks our highest good and teaches us to seek the greatest good of others, even those who hate and abuse us.
Overcome evil with good Our love for others, even those who are ungrateful and selfish towards us, must be marked by the same kindness and mercy which God has shown to us. It is easier to show kindness and mercy when we can expect to benefit from doing so. How much harder when we can expect nothing in return. Our prayer for those who do us ill both breaks the power of revenge and releases the power of love to do good in the face of evil.
Christ's redeeming love and mercy frees us from all hatred and malice towards others How can we possibly love those who cause us harm or ill-will? With God all things are possible. He gives power and grace to those who believe and accept the gift of the Holy Spirit. His love conquers all, even our hurts, fears, prejudices and griefs. Only the cross of Jesus Christ can free us from the tyranny of malice, hatred, revenge, and resentment and gives us the courage to return evil with good. Such love and grace has power to heal and to save from destruction. Do you know the power of Christ’s redeeming love and mercy?
Allow the Holy Spirit to change and transform the way you think, judge, and treat others Was Jesus exaggerating when he said we must be perfect as our heavenly Father is perfect? The original meaning of  "perfect" in Aramaic is "completeness" or "wholeness - not lacking in what is essential." God gives us every good gift in Jesus Christ so that we may not lack anything we need to do his will and to live as his sons and daughters (2 Peter 1:3). He knows our weakness and sinfulness better than we do. And he assures us of his love, mercy, and grace to follow in his ways. Do you want to grow in your love for God and for your neighbor? Ask the Holy Spirit to change and transform you in the image of the Father that you may walk in the joy and freedom of the Gospel.
Prayer:
"Lord Jesus, your love brings freedom and pardon. Fill me with your Holy Spirit and set my heart ablaze with your love that nothing may make me lose my temper, ruffle my peace, take away my joy, nor make me bitter towards anyone."
