hello!! given that it is the first weekend in june, i'd like to go through everything that i read in the month of may and say if i would or would not recommend it and why. lets go !!

in chronological order of reading:

king of pride - ana huang: YES absolutely! god i loved this book. more specifically, yes i would recommend it if you like opposites attract in romance and dating, or if you like income gap relationships ( he's a billionaire, she's a struggling author ), and yes if you like incredibly hot and well written spicy scenes between characters. i honestly can't even think of a no unless you literally just hate spicy romance as a genre; even then i still think this book deserves a chance for your time. i absolutely adore this book.

2. den of vipers - k.a. knight: yes if you miss reading self-insert on wattpad and like pick me fmcs. the vipers themselves do have a lot of good character behind them, but as far as the fmc...i just really didn't like her. i did finish the entire book hoping that it would get better towards the end, but in my opinion the ending was one of the worse parts of the book and throughout it all it felt very predictable. would i generally recommend this? no. but it's definitely a hit or miss book. you'll either really like it, or not like it at all.

3. does it hurt? - h.d. carlton: yes yes yes yes yes. this was my favorite read of the month of may. i'd recommend it even more if you like witty and funny fmcs; it's sort of a dark romance version of grumpy x sunshine. it has a lot of spice and it's very creative if that makes sense? it's not just boring vanilla missionary, that's for sure. the mmcs character is phenomenal and both of them each have very full character arcs. but i wouldn't recommend it if mentions of incest and domestic abuse trigger you, or if body horror and gore triggers you.

4. never lie - freida mcfadden: yes if you're new to thrillers and want something easy to digest. definitely not if you're not new to thrillers and have read some absolutely breathtaking ones that kept you up at night. to me it had a rather predictable storyline, a twist that falls flat, and characters with absolutely zero depth or anywhere near a completed arc. i really did not like this book at all. also yes if you like a quick read; this didn't take me very long to get through.

5 + 6. there are no saints / there is no devil [ sinner's duet ] - sophie lark: yes if you like a "beginner" dark romance that doesn't stray too far into depravity, but still has a very dominant and demanding mmc. no if you've read things by h.d. carlton or other dark romance authors and that's your expectation level. this might come off as boring to you. however as this was a bit tame for me storyline wise, the spicy scenes were amazing and i did like that they were both artists. i feel like usually billionaires are business-oriented but it was cool to see a wealthy and famous artist. also yes if you like mentor romance dynamics.

7. iced out - veronica eden: yes if you like boys who are very clearly written by women ( in a good way! ). the mmc is perfectly balanced; he's as hot and dominant as he is cute and sweet and nice and thoughtful. he's pretty much the picturesque model citizen for what a girl typically would want in a perfectly healthy romantic relationship. there's very little drama between characters, which i personally liked. but no if parental death or familial death or grief/loss are triggers for you. for a more in-depth response, i did a spoiler free book review here!

Never Lie by Freida McFadden

Another great read from Freida McFadden. There were so many twists I got whiplash. I thought I knew what was happening, only to be quickly proven wrong. The whole story is so convoluted, but in the best way. I never saw any of it coming, which made it incredibly fun. A little creepy and unsettling with the mystery person hiding in the house with Tricia and Ethan, but that wasn't who anyone needed to be worried about.

This book redeemed Freida McFadden for me! I give this book a 9/10, I was really happy with the story and the plot line and the twists. Without spoiling too much, this book didn't have much character growth however it was ok in this scenario. I also listened to this in one sitting which I usually cannot do with books! I do recommend this!

INSURER’S INSTIGATION OF SETTLEMENT IS EVIDENCE OF GOOD FAITH

After parties to a suit resolved the suit by settlement one or more of the parties tried to renege on the agreement and appealed the trial court’s order to enforce the parties’ settlement agreement. The parties’ settlement agreement required them to dismiss all claims, counterclaims, and crossclaims with prejudice. In Shorewood Forest Utilities, Inc. v. Rex Properties, LLC and Don Blum, No. 22A-PL-2345, Court of Appeals of Indiana (August 11, 2023) the Court of Appeals resolved the claims concerning the Settlement Agreement.

FACTS AND PROCEDURAL HISTORY

Shorewood is a nonprofit corporation that provides sewer service to more than 1000 residents in Porter County. Rex Properties is a property developer, and Blum is the sole managing member of Rex Properties. In 2017, Shorewood and Rex Properties entered into an agreement for Shorewood to expand into a new Rex Properties development and service the homes there according to certain terms, rates, and fees. Not long thereafter, Shorewood concluded that its agreement with Rex Properties was not enforceable, and Shorewood declined to participate in the project.

By mid-2019, the only claim remaining in the instant cause was Rex Properties’ approximately sixteen-million-dollar counterclaim against Shorewood for breach of contract. Shorewood sought to amend its complaint to allege claims of fraud, fraud in the inducement, unjust enrichment, and criminal deception against Rex Properties. In March 2020, the trial court permitted Shorewood’s requested amendment.

In the spring and summer of 2020, the parties attempted to settle out of court. On June 8, counsel for Shorewood sent counsel for Rex Properties an email stating that Shorewood’s insurance carrier, Stratford Insurance, had agreed to pay Rex Properties $950,000 for Shorewood and Rex Properties to settle and dismiss all claims, counterclaims, and crossclaims in this cause.

Mr. Blum approved the settlement with the terms set forth in the offer email.

Over the next several weeks, the parties’ attorneys worked on drafting a Settlement Agreement. Counsel drafted an agreement but Shorewood refused to sign it. Accordingly, Rex Properties filed a Motion to Enforce Settlement Agreement on the ground that the June 8 email exchange represented an enforceable agreement between the parties whereby Stratford Insurance would pay Rex Properties $950,000 and, in exchange, Shorewood and Rex Properties would dismiss all claims in this cause with prejudice.

THE ISSUES

The central issue in this appeal is whether the email exchange between the parties on June 8 represented the offer and acceptance of an enforceable settlement agreement. The trial court concluded that the parties’ June 8 email exchange created an enforceable settlement agreement.

Shorewood had made an offer, Rex Properties accepted the offer, there was more than ample consideration between them and Stratford Insurance, and all parties had a meeting of the minds over definite and certain essential terms.

Shorewood claims that Stratford Insurance colluded with Rex Properties and somehow kept Shorewood “in the dark and uninformed” about the “terms, conditions, requirements, and payments” to be made to Rex Properties.

The trial court’s denial of Rex Properties’ motion for judgment on the pleadings and its motion for summary judgment resulted in a settlement agreement between Shorewood and Rex Properties, and their settlement rendered the trial court’s prior judgments moot.

The trial court’s judgment was affirmed.

ZALMA OPINION

Courts invariably prefer settlement agreements. Insurers, like Stratford, prefer settlements. In this case Stratford put up almost $1 million to settle, the parties agreed by e-mail and an agreement to memorialize the agreement with a formalized agreement. The contract was made by the e-mail exchange of offer, acceptance and consideration. The formalized agreement was not necessary and the good work of the insurer resulted in a solution to an extensive case and protected its insured.
