PROCESS TO FILE A COMPLAIN AGAINST PROPERTY FRAUD

The real estate boom in recent years has everyone beeline towards investing in real estate. But despite the advent of RERA, real estate dealings in India can be prone to manipulation and you still hear case of frauds, misrepresentation and forgery.

MUTUAL SETTLEMENT

Mutual settlement among the parties can be an affordable and hassle free way to settle the cases as it does not take time or spending a lot of money in the form of lawyers and other fees.

APPROACH THE JUDICIARY

If both the parties do not agree for a mutual settlement, the only option is to file a case and approach the judiciary through an appointed lawyer or an advocate.

You should be aware about the different cases that might arise as a fraud while purchasing a property –

1. Failure to honor an agreement –

This is one of the classic example of fraud. Let’s say a buyer has paid an advance for a property, and the developer has accepted the same. But the developer or owner dishonors the agreement and sells the property to another person.

In this case, the first person who bought the property can file a police complaint and file a suit against the seller. For cases of this nature, the court generally issues a stay order. It is also good practice to send a notice to the other buyer informing him of your position.

2. Property that was taken over fraudulently-

This is generally the case involving fraudulent signatures and misrepresentation. Often, people are duped into the transfer of their property without their knowledge.

In these cases too, a case of fraud and misrepresentation should be filed in addition to petitioning the court to declare the subsequent sale as invalid.

3. Misrepresentation of Seller’s Kin –

Cases of this nature have become quite common of late. A sale would have taken place in the right order and a few months/years later, some individual claiming to be the legal heir/relative of the seller file a suit against the buyer.

To avoid landing up at the doors of the court with cases like these, it is always to get the property papers verified by the lawyer and carry out a thorough check from all angles before buying a property.

In all the above cases, the key factor is getting a good lawyer or advocate appointed and seek advise in order to proceed further.

@amtrak-official y’all need to add more monthly rail pass options… if the train operates everyday, anyways, why can’t I select a monthly rail pass for my commute?

Seriously, not being able to choose two stops I know I will use frequent enough to buy a rail pass is turning away profit and forcing me to drive a car or spend too much money. I thought the people want railway expansion and affordable, reliable, usable public transit?

On top of that, this prevents me from being able to work elsewhere without using a car or becoming an ultra cyclist. Y’all hurting the U.S. and state level economies by charging me day passes for a fucking train that operates everyday and I’d like to use frequently.

I want my community space to be a fucking train, man!!!

Young Justice is made up of snarky traumatized losers with terrible coping skills so whenever something bad happens or just mildly inconveniences them, they’ll just mutter something completely out of pocket

I got literally screamed at by a professor at my college today who overheard me speaking to another student about the pro-Palestinian protest on my campus. I am blown away by the absolute lack of professionalism and the completely offensive things she said. She can scream her head off, she isn't shaking our students. Palestine will be free.
