If people in a position of authority are using calls of antisemitism to make mass arrests and justify police brutality, then I think it’s safe to say they don’t care about the safety of Jews and only about defending a colonial and neo-liberal status quo. Especially when Jews are disproportionately represented among arrestees.

Am I Nuts for Thinking a Jewish Florist Should Have To Make an Easter Arrangement?

One thing I tried to impress upon my Con Law students this semester (and every semester) is that the interplay between anti-discrimination law and freedom of speech (and freedom of religion) is complicated and raises a host of thorny questions that defy easy resolution. These issues, of course, lie at the forefront of the 303 Creative case currently before the Supreme Court, which I'm sure will address them with the care, nuance, and sensitivity they deserve [/sarcasm].

But on that matter, I want to flag a hypothetical offered by prominent First Amendment specialist and former federal judge Michael McConnell, to get folks' intuitions on:

What if a Jewish florist is asked to design the floral display of white lilies on Easter Sunday morning at a Christian church? Ordinarily, flowers are just flowers. But the lilies in church on Easter morning are a symbol of the new life in Christ. I cannot believe that a free nation would compel a Jewish florist to construct a symbol of Christ's resurrection—on pain of losing the right to be a florist.

McConnell frames this as his "personal favorite hypothetical", and clearly perceives it as a knockout argument for the pro-free speech/religious liberty side. But perhaps I'm not fully grasping the facts, because speaking as a Jew this prospect doesn't seem that frightening to me.

Suppose I'm a Jewish florist. A customer comes in and says "I've seen the lovely work you've done with white lilies, could you please make a similar display for me?" I agree, since I have loads of experience working with white lilies. The customer then says, "thanks -- we plan on putting this display up in our church on Easter morning!" This prospect ... doesn't upset me. I don't intuitively think I should be able to refuse the customer, notwithstanding the fact that I obviously don't believe in the divinity of Christ, and I don't view continuing to serve the customer as forcing me to avow any beliefs I don't hold.

At root, the reason why this prospect isn't bothersome is because I don't view my customer's use of my flowers as representing my speech. I just design the flowers; what they do with it is their business. If someone sees the arrangement at church and learns that David's Flowers created it, I do not expect them to think "wow, I had no idea David believed in Christ's divinity!" This isn't to say I have no free speech concerns regarding flower arrangements -- I would very much chafe at government regulations that, for example, regulate what shapes I can use in my designs. That part very much is my expression, would be attributed to me -- the churchgoer who compliments the pattern of the flowers would credit those decisions to David's Flowers (I wrote about this a few years ago as the problem of partially expressive conduct).

There are still plenty of tough cases at the margins. I show my customer a preliminary design; they twist their lip and say "I dunno ... it's just not capturing the majesty of Christ's resurrection, you know?" I'm at a loss ("So ... bigger?"). But I'm inclined to think that while such an example might demonstrate why I might be a bad choice to design the arrangement, it doesn't give me the right to discriminate against the customer if they are in fact thrilled with the work I do and have done for other customers.

For me, then, McConnell's hypothetical has the opposite effect than what he intended. And of course, for many Jews -- particularly Jews who live in predominantly non-Jewish areas -- the more salient threat is that local businesses will be given carte blanche authority to refuse to service any of our religious life cycle events lest it be seen as "approving" of them. To let vendors say "ordinarily, a cake is just a cake -- but a cake served at a Bar Mitzvah has religious significance that we, as Christians, cannot approve of" is not a door I want to open.

But perhaps some of my readers disagree. Curious to hear people's thoughts on this.

Jewish Justice

Back in 1840 a little jewish girl around 9 years old Anne Frank was trying to survive with her family in a office building because she was jewish and she didn't want to die in her country. She was 15 years old when she and family was transfered to a jewish camp and then murdered along with family and other heros/heroic family's in that camp. More is to be done to help the Jewish communities live a safe and productive life it seems in all parts of the world. Netherlands is no exception. Statue of liberty stands for people to have freedom. Rest in peace Anne Frank and the Jewish community who parished. There are possibly still areas where Jewish families are trying to flee from war to prevent themselves from being tortured or murdered.. America does care about all people no matter the color of yheir skin... prayers for their safety

The "religious liberty" angle for overturning the overturning of Dobbs

Frank Wilhoit’s definition of “conservativism” remains a classic:

There must be in-groups whom the law protects but does not bind, alongside out-groups whom the law binds but does not protect.

Conservativism is, in other words, the opposite of the rule of law, which is the idea that the law applies equally to all. Many of America’s most predictably weird moments live in the tension between the rule of law and the conservative’s demand to be protected — but not bound — by the law.

Think of the Republican women of Florida whose full-throated support for the perfomatively cruel and bigoted policies of Ron Desantis turned to howls of outrage when the governor signed a law “overhauling alimony” (for “overhauling,” read “eliminating”):

This is real leopards-eating-people’s-faces-party stuff, and it’s the only source of mirth in an otherwise grim situation.

But out of the culture-war bullshit backfires, none is so sweet and delicious as the religious liberty self-own. You see, under the rule of law, if some special consideration is owed to a group due to religious liberty, that means all religions. Of course, Wilhoit-drunk conservatives imagine that “religious liberty” is a synonym for Christian liberty, and that other groups will never demand the same carve outs.

Remember when Louisiana decided spend tax dollars to fund “religious” schools under a charter school program, only to discover — to their Islamaphobic horror — that this would allow Muslim schools to get public subsidies, too?

And now we come to Dobbs, and the cowardly, illegitimate Supreme Court’s cowardly, illegitimate overturning of Roe v Wade, a move that was immediately followed by “red” states implementing total, or near-total bans on abortion:

These same states are hotbeds of “religious liberty” nonsense. In about a dozen of these states, Jews, Christians, and Satanists are filing “religious liberty” challenges to the abortion ban. In Indiana, the Hoosier Jews For Choice have joined with other religious groups in a class action, to argue that the “religious freedom” law that Mike Pence signed as governor protects their right to an abortion:

Their case builds on precedents from the covid lockdowns, like decisions that said that if secular exceptions to lockdown rules or vaccine mandates existed, then states had to also allow religious exemptions. That opens the door for religious exemptions to abortion bans — if there’s a secular rule that permits abortion in the instance of incest or rape, then faith-based exceptions must be permitted, too.

Some of the challenges to abortion rules seek to carve out religious exemptions, but others seek to overturn the abortion rules altogether, because the lawmakers who passed them explicitly justified them in the name of fusing Christian “values” with secular law, a First Amendment no-no.

As Rabbi James Bennett told Politico’s Alice Ollstein: “They’re entitled to their interpretation of when life begins, but they’re not entitled to have the exclusive one.”

In Florida, a group of Jewish, Buddhist, Episcopalian, Universalists and United Church clerics are challenging the “aiding and abetting” law because it restricts the things they can say from the pulpit — a classic religious liberty gambit.

Kentucky’s challenge comes from three Jewish women whose faith holds that life begins “with the first breath.” Lead plaintiff Lisa Sobel described how Kentucky’s law bars her from seeking IVF treatment, because she could face criminal charges for “discarding non-viable embryos” created during the process.

Then there’s the Satanic Temple, in court in Texas, Idaho and Indiana. The Satanists say that abortion is a religious ritual, and argue that the state can’t limit their access to it.

These challenges all rest on state religious liberty laws. What will happen when some or all of these reach the Supreme Court? It’s a risky gambit. This is the court that upheld Trump’s Muslim ban and the right of a Christian baker to refuse to bake a wedding cake for a same-sex couple. It’s a court that loves Wilhoit’s “in-groups whom the law protects but does not bind, alongside out-groups whom the law binds but does not protect.”

It’s a court that’s so Wilhoit-drunk, it’s willing to grant religious liberty to bigots who worry about imaginary same-sex couples:

But in the meantime, the bigots and religious maniacs who want to preserve “religious liberty” while banning abortion are walking a fine line. The Becket Fund, which funded the Hobby Lobby case (establishing that religious maniacs can deny health care to their employees if their imaginary friends object), has filed a brief in one case arguing that the religious convictions of people arguing for a right to abortion aren’t really sincere in their beliefs:

This is quite a line for Becket to have crossed — religious liberty trufans hate it when courts demand that people seeking religious exemptions prove that their beliefs are sincerely held.

Not only is Becket throwing its opposition to “sincerely held belief” tests under the bus, they’re doing so for nothing. Jewish religious texts clearly state that life begins at the first breath, and that the life of a pregnant person takes precedence over the life of the fetus in their uterus.

The kicker in Ollstein’s great article comes in the last paragraph, delivered by Columbia Law’s Elizabeth Reiner Platt, who runs the Law, Rights, and Religion Project:

The idea of reproductive rights as a religious liberty issue is absolutely not something that came from lawyers. It’s how faith communities themselves have been talking about their approach to reproductive rights for literally decades.

It is also common to hear criticism of Israel described as antisemitic, a fact that has resulted in the paradox of the German state actively suppressing those Jewish voices that do not conform to their expectations. A state-owned cultural center, Oyoun, faces defunding by the Berlin Senate for hosting an evening of “mourning and hope” put together by Jewish Voice for Just Peace in the Middle East, a Jewish organization. On November 9, the city of Frankfurt on Main forbade a planned rally called “Never again fascism – remembering Kristallnacht, fighting anti-Semitism,” apparently due to the organizer’s past support for Palestine. The police continue to selectively enforce bans on such phrases as “stop genocide,” “free Palestine,” and “stop the war,” often with no prior announcement. A sanctioned protest in Berlin on November 10, organized by a coalition of Jewish and Israeli groups, resulted in several arrests due to the sudden mid-protest banning of some of these phrases. They included the arrest of a Jewish-Israeli woman who held a sign that read: “As a Jew and Israeli: Stop the Genocide in Gaza.” The war in Gaza comes at a moment when every major political party in Germany is lurching rightward on the issue of migration, embracing xenophobic and Islamophobic policies once reserved for the marginalized far right. “Germany cannot accept any more refugees,” Friedrich Merz, the leader of the Christian Democratic Union, the party of Merkel, said. “We have enough antisemitic men in this country.” Scholz, a Social Democrat, appeared on the cover of Der Spiegel in a determined portrait framed by the quote: “We must finally deport on a grand scale.” The specter of antisemitism has proved opportune for mainstream parties, which are threatened by a surge in popularity for the far-right Alternative for Germany, or AfD, whose platform is proudly anti-immigrant. ... Just as reports of attacks on mosques have risen since October 7, recent incidents of antisemitic crimes have produced fear among Jews in Germany. Stars of David have been painted outside Jewish homes; a synagogue in Berlin was firebombed, albeit with no injuries or property damage. These are not isolated events; the number of antisemitic incidents in 2021 was the highest since authorities began tracking them. Yet politicians’ focus on Muslims and migrants as their source runs contrary to the facts. According to the federal police, the “vast majority” of antisemitic crimes – more than 80 percent — are committed by the far right.

The Judeo-Christian's Junior Partner

It's hardly a revelation at this point to observe how the "anti-CRT" style bills have quickly become tools to censor Jewish and Holocaust education. A recent story out of Florida, where a school district cited Florida's "don't say gay" bill to block a parent from giving an educational (but non-theological) presentation to teach students what Channukah is, wouldn't even be especially noteworthy (the district did eventually reverse itself). But there were some details in the story that I thought were illustrative about the location Jews are perceived to occupy in religious pluralism discourse versus the position we actually occupy.

The first thing to note about this district is that it is not some sentinel of secularism. The schools reportedly are replete with "holiday" decorations that are very much tied to Christmas. Nonetheless, when the parent tried to schedule her yearly Channukah presentation, the district demurred on the grounds that if the school allowed such an event, "“they would have to teach Kwanza and Diwali."

To which the Jewish parent replied: "I think that would be awesome!"

What we see here is how "Judeo-Christian" renders Judaism the (very, very) junior partner. Christians won't actually give Jews equal standing with Christians in terms of holiday exposure; as the "junior" they're not entitled to such largesse. But Christians assume nonetheless that Jews remain partners in the desire to maintain "Judeo-Christian" hegemony against upstart interlopers like Hindus or African-Americans. The idea that Jews would not be horrified by, but would in fact welcome, greater inclusion for other minority faiths and creeds -- that Jews actually identify more with other minority faiths and creeds than they do with hegemonic Christianity -- is incomprehensible.

The reality is that this unequal partnership is a creature of the Christian, not Jewish, imagination. Even if "Judeo-Christian" ever actually were a relationship of equals -- and I scarcely imagine it -- the fact is Jews do not see ourselves as part of this "Judeo-Christian" collective with a shared interest in standing against other minorities. That religious outsiders might be included is for us a feature, not a bug.

It’s become a real challenge to keep up with every Palestine protest and action happening in this country, but I am going to round-up some of that have occurred in recent days in case you missed them. Over 75 activists shut down and blocked all entrances to Boeing Building 598 in Saint Charles, Missouri. The facility manufactures the Small Diameter Bombs (SDBs) and Joint Direct Attack Munition (JDAM) bombs that Israel is using Gaza. “We are joining millions of people across the United States and around the world in demanding an end to Israeli’s brutal assault on Gaza and its decades-long occupation of Palestine,” said Ellie Tang, a member of the anti-war organization Dissenters, in a statement. “We urge Congress and Biden to hear the calls of millions of us living in this country, and push for a ceasefire. Until Congress blocks the bombs, we will.” After shutting operations down for 2 hours, the facility canceled its deliveries for the day. 500 protesters with Jewish Voice for Peace (JVP) took over the Statue of Liberty’s platform, dropped banners, held a sit-in, and chanted for a ceasefire. “HAPPENING NOW AT THE STATUE OF LIBERTY: Hundreds of Jews and allies are holding an emergency sit-in, taking over the island to demand a ceasefire in Gaza. We refuse to allow a genocide to be carried out in our names. Ceasefire now to save lives! Never again for anyone!,” tweeted the organization. Oakland protesters blocked a ship from leaving its port for hours. The boat was headed to the Port of Tacoma to pick up arms destined for Israel. Hundreds of protesters are currently occupying that port and at least one worker is refusing to take the cargo after learning about its use. At a Get Out the Vote rally, Democratic candidate Senator John Fetterman (D-PA) was confronted by a protester calling for a ceasefire. “4,000 plus dead children in Palestine. 9,000 plus dead civilians, get off the stage. … Get off the stage. I don’t care … get off the stage,” he yelled before being escorted out of the building by police. Tens of thousands gathered in San Francisco to demand a ceasefire. “I can feel the momentum of it and that’s why we had to get out today,” one told the local CBS station. “My son’s in Trafalgar Square right now or he was earlier today. Same deal. People who just feel the injustice of the world.” A speech by Senator Cory Booker (D-NJ) in New Jersey was interrupted by activists calling on him to back a ceasefire. He quickly exited the stage. Rhode Island Senators Jack Reed and Sheldon Whitehouse were disrupted at event by protesters calling for a ceasefire. Rep. Grace Meng was confronted by protesters asking when she will back a ceasefire. She remained silent and her staff told them, “There’s a time and place for this.”

Every once in a while, I think about how Raphael Lemkin, a Polish (and JEWISH, this is important) man who coined the term ‘genocide’ never kept quiet about “yes, USSR, I DO mean the Holodomor counts, too!” How the USSR blocked every attempt to make the official definition include what happened to Ukrainians in the early 1930s. That the only way it got approved for the use in legal trials and such like Nuremberg was because everyone bowed to USSR’s pressure to hide their evil doing.

The man went to his grave fighting to call Holodomor a genocide. Just like the Holocaust. Just like the Armenian Genocide.

This isn’t some bullshit ‘death of the author’ or what the fuck ever. This is telling a man who had very clear rules in mind for what counts that he’s WRONG about a thing HE CAME UP WITH.

In essence:

A Polish Jew creates the term ‘genocide’. Everyone tells him he’s wrong about the definition of a term he created. He knew exactly what he was doing when he created the term and gave the examples of what he knew to be considered the term he created.

Raphael Lemkin lost 49 PEOPLE IN THE HOLOCAUST and you DARE to say you KNOW BETTER THAN HIM what counts as a GENOCIDE? (Yea, 49. Only like 3 relatives survived. May all their memories be a blessing.)

The Nuremberg Trials would never have happened the way they did without Raphael Lemkin but he doesn’t fucking have the right to call something a genocide SOMEHOW.

In 1953 he published a whole speech/article that literally said “Soviet Genocide in Ukraine” aka Holodomor.

But sure, because that one little time Holodomor wasn’t included means it was never meant to be considered one.

Raphael Lemkin, in his own words on his original definition of genocide:

“Genocide does not necessarily mean the immediate destruction of a nation, except when accomplished by mass killings of all members of a nation. It is intended rather to signify a coordinated plan of different actions aiming at the destruction of essential foundations of the life of national groups, with the aim of annihilating the groups themselves. The objectives of such a plan would be disintegration of the political and social institutions, of culture, language, national feelings, religion, and the economic existence of national groups, and the destruction of the personal security, liberty, health, dignity, and even the lives of the individuals belonging to such groups. Genocide is directed against the national group as an entity, and the actions involved are directed against individuals, not in their individual capacity, but as members of the national group.”

Raphael Lemkin, of blessed memory, knew exactly what he was saying. Poland and Ukraine have always been neighbors and have both been bullied by Russia. To say nothing of having their borders shifted around that a Pole could find themselves a Ukrainian and vice versa one year then go back to the start the next year. Raphael Lemkin, coiner of the term genocide, saw the destruction of the Holodomor and the Shoah and knew they both fit his definition.

Pray tell how a nation such as Russia can overrule the man who coined the term of their crime?

Raphael Lemkin would call the war the exact thing it is: genocide. We all know it. And I for one will continue his fight to making sure everybody knows exactly what Russia represents and what they have done and will continue to do until we are believed more readily than people want to believe an ex-KGB fuckhead.
