india supreme court does not make same sex marriage legal :(
I doubt many of us were expecting anything different but it's still very saddening... I feel like not many of us even knew the court case was happening. The ray of light here is that the court case happened in the first place but we still have a ways to go.
The first step is to spread awareness, though! We can't let this court case be totally forgotten and vanish into obscurity.

India's Supreme Court has declined an appeal to legalize same-sex marriages.
The top court announced the ruling on Tuesday (17/10/2023) after hearing arguments in April and May, with three of five justices finding that the issue should be decided by parliament.
“The court, in the exercise of the power of judicial review, must steer clear of matters, particularly those impinging on policy, which fall in the legislative domain,” Chief Justice Dhananjaya Yeshwant Chandrachud said.
The court instead endorsed a government proposal to establish a panel to consider bestowing certain rights and benefits to same-sex couples.
Chandrachud said the state should provide some legal protections to same-sex unions, arguing that denying them “benefits and services” granted to heterosexual couples violates their fundamental rights.
TL;DR: The Supreme Court declared that queer couples have the right to enter into civil unions, though they do not have the right to marry under existing laws.

very important fundraiser for a very cool person whose life is really sucky right now. here is the instagram post.
TLDR (and also because it's very late at night and i am too tired to write image descriptions); Sanch (@/sleepysoyabean on ig) is an indigenous/Adivasi queer person from Assam, India who just got a breast cancer diagnosis and needs helps with their bills and expenses for the treatment, which includes a procedure called thoracentesis to remove fluid from their lungs, implementation of hormone blockers and the actual surgery plus chemo and radiation.
This fundraiser is being organised by their friend Rhea Mukherjee (@/rheealization on ig) and partner Ankur Gedam (@/da.lit.vegan on ig). The end goal to be met is about 5 lakh Indian Rupees, which is 6,071 usd. Sanch has massively helped my understanding and learning of marxism, casteism, veganism and neglected sections of indian politics in general, and I'm sure she's helped with many other people's political awakenings and learnings as well. They have also been very helpful to lgbt+ Indians from abusive and queerphobic families and have organised fundraisers to provide housing, basic commodities, trans and queer-related healthcare to so many people. She really deserves as much help as she can get, and this is a very urgent and precarious situation. Even just 1 us dollar amounts to 82.36 Indian rupees in the current economy.

India is a conservative country and we all know the social prestige attached to a marriage. Not to mention the legal, economic and social benefits. Gay couples have a right to those as much as heterosexual couples do. Marriage is not a fundamental right, my ass
And they know very well that with the conservative government that's sitting in the Parliament right now, we are never getting a marriage equality act passed. The case is closed now.
